MANJABIN WIFE OF MANZAR ALAM<br \/>\n                                            Versus<br \/>\n                                     STATE OF BIHAR<\/p>\n<p>2.   17.6.2010            Heard learned counsel for the petitioners, the State<\/p>\n<p>                 and the informant.\n<\/p>\n<p>                          The petitioners seek bail in a case instituted for the<\/p>\n<p>                 offence under sections 498A, 323 and 307\/34 of the Indian<\/p>\n<p>                 Penal Code.\n<\/p>\n<p>                          It has been submitted that initially the petitioners were<\/p>\n<p>                 granted anticipatory bail by the Sessions Judge, but the<\/p>\n<p>                 informant file an application for cancellation of bail, which<\/p>\n<p>                 petition was allowed. As against the cancellation of bail the<\/p>\n<p>                 petitioners moved before the Hon&#8217;ble Supreme court for bail,<\/p>\n<p>                 but the application was disposed of with an observation that the<\/p>\n<p>                 petitioners file an application for regular bail within a period of<\/p>\n<p>                 two weeks, till which time they would not be arrested. In honour<\/p>\n<p>                 of the direction of the Hon&#8217;ble Supreme court the petitioners<\/p>\n<p>                 appeared before the A.C.J.M., Patna City on 30.4.2010 and<\/p>\n<p>                 they are in custody since then.\n<\/p>\n<p>                          Considering the period of custody as also the<\/p>\n<p>                 undertaking that the petitioners will fully co-operate in the trial<\/p>\n<p>                 and not tamper with the prosecution evidence, let the<\/p>\n<p>                 petitioners, named above, be released on bail on furnishing bail<\/p>\n<p>                 bonds of Rs. 5,000\/- (five thousand) each with two sureties of<\/p>\n<p>                 the like amount each to the satisfaction of Additional Chief<br \/>\n<span class=\"hidden_text\">                                  -2-<\/span><\/p>\n<p>            Judicial Magistrate, Patna City in Alamganj P.S.case No.138 of<\/p>\n<p>            2007, subject to the conditions (i) that one of the bailors will be<\/p>\n<p>            a close relative of the petitioners, who will give an affidavit<\/p>\n<p>            giving genealogy as to how he is related with the petitioners.<\/p>\n<p>            The bailors will undertake to furnish information to the court<\/p>\n<p>            about any change in the address of the petitioners, (ii) that the<\/p>\n<p>            petitioners will give an undertaking that they will receive the<\/p>\n<p>            police papers on the given date and be present on the date<\/p>\n<p>            fixed for charge and if they fail to do so on two given dates and<\/p>\n<p>            delays the trial in any manner, their bail will be liable to be<\/p>\n<p>            cancelled for reasons of misuse and (iii) that the petitioners will<\/p>\n<p>            be well represented on each date and if they fail to do so on two<\/p>\n<p>            consecutive dates, their bail will be liable to be cancelled.<\/p>\n<pre>Narendra\/                        ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Manzar Alam &amp;Amp; Anr vs State Of Bihar on 17 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
