BHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/04\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)<\/p>\n<p>1.0\tPresent<br \/>\napplication is filed by the State of Gujarat through learned Public<br \/>\nProsecutor, High Court of Gujarat, Ahmedabad seeking leave to appeal<br \/>\nagainst judgment and order dated<br \/>\n30th September 2010,<br \/>\npassed by the learned Special Judge, Amreli in Special (ACB) Case No.<br \/>\n57 of 2003, whereby, the learned Judge was pleased to record<br \/>\nacquittal under Section 235(1) of the Code of Criminal Procedure in<br \/>\nthe matter of Prevention of Corruption Act, 1988, for the offences<br \/>\npunishable under Sections 7, 13(1)(d), 13(2).\n<\/p>\n<p>2.0\tThe<br \/>\nlearned Additional Public Prosecutor Mr. Shah vehemently submitted<br \/>\nthat the learned Judge has committed an error in recording acquittal<br \/>\ndespite the prosecution placing on record oral as well documentary<br \/>\nevidence in support of its case.  The learned Additional Public<br \/>\nProsecutor invited the attention of the Court to the grounds set out<br \/>\nin Appeal Memo, on which, the judgment and order of acquittal is<br \/>\nassailed.\n<\/p>\n<p>3.0\tOn<br \/>\nperusal of the judgment and order, it is noticed that in Sub-Para 2.1<br \/>\nof Para 21, the learned Judge has recorded that, &#8216;the witness of<br \/>\nthe prosecution &#8211; Hanubhai Mulubhai, exh. 32 has deposed that<br \/>\nthe accused and the complainant had a monetary transaction and<br \/>\naccused had lent money to the complainant and this fact was within<br \/>\nhis knowledge&#8217;.  The learned Judge has rightly appreciated this<br \/>\nfact and has observed that, &#8216;if there is evidence to the effect<br \/>\nthat the accused and the complainant had monetary transaction of<br \/>\nlending money and complainant returned that money to the accused, if<br \/>\nthe amount is recovered from the accused, it cannot be<br \/>\npresumed that, that amount was offered as illegal gratification&#8217;.<br \/>\n Besides, the leaned Judge has also appreciated in Sub-Para 4 of Para<br \/>\n21 that, &#8216;there is discrepancy in the evidence about the place at<br \/>\nwhich the amount was recovered from the accused&#8217;, and this created<br \/>\nsuspicion in the mind of the learned Judge.\n<\/p>\n<p>3.1\tThe<br \/>\nlearned Judge has also mentioned in Para 22 that, &#8216;the prosecution<br \/>\ncould not examine the complainant, as he had expired&#8217;, this might<br \/>\nhave hampered the case of the prosecution but then the Court has to<br \/>\nadjudicate a matter on the basis of the evidence placed before it&#8217;.\n<\/p>\n<p>4.0\tTaking<br \/>\ninto consideration the totality of the evidence led before the<br \/>\nlearned Judge and the relevant discussion on the point, this Court is<br \/>\nof the opinion that learned Judge has not committed any error in<br \/>\nrecording acquittal.
