NO. 31859 OF 2009\n                   --------------------------------------------\n\n                  Dated this the 16th day of February, 2010\n\n\n                                JUDGMENT\n<\/pre>\n<p>       The petitioner is a rank holder in the list published by the Public<\/p>\n<p>Service Commission for appointment to the post of Junior Health Inspector<\/p>\n<p>Grade- II, on 11.9.2007. This Writ Petition has been filed mainly with the<\/p>\n<p>prayer to accept Ext.P2 certificate and to consider the petitioner as fully<\/p>\n<p>qualified for appointment to the said post. In the Writ Petition, a counter<\/p>\n<p>affidavit has been filed by the first respondent wherein it is specifically<\/p>\n<p>stated that taking into account the qualifications specified in the rules<\/p>\n<p>relating to the appointment to the post of Junior Health Inspector Grade-II,<\/p>\n<p>two main lists were prepared. List I contains names of 11 candidates<\/p>\n<p>possessing the technical qualification of Multi purpose Workers Training<\/p>\n<p>certificate issued by the Kerala State Health Services Department or its<\/p>\n<p>equivalent.    List II contains names of candidates possessing Health<\/p>\n<p>Inspector Training Certificate Sanitary Training Certificate (Diploma of<\/p>\n<p>AIILSG, Mumbai) or its equivalent. The petitioner is holding Rank No.14<\/p>\n<p>in the supplementary list of Muslim candidates under List II. As per the<\/p>\n<p>counter affidavit, Muslim candidates up to rank No.142 were advised from<\/p>\n<p><span class=\"hidden_text\">W.P.(C) NO.31859 of 2009               2<\/span><\/p>\n<p>the Main List in List II and 4 more Muslim candidates remain to be<\/p>\n<p>advised in the Main List of List II. It is also stated that the turn of the<\/p>\n<p>petitioner who is included as rank No.14 in the Muslim Supplementary<\/p>\n<p>List of List II has not arisen so far. Since the list was brought into effect<\/p>\n<p>from 11.9.2007, it would remain valid up to 10.9.2010 if no new list is<\/p>\n<p>drawn and published in the meanwhile. Taking note of the aforesaid<\/p>\n<p>statements in the counter affidavit filed by the first respondent, no relief<\/p>\n<p>can be granted to the petitioner at this stage. Therefore, the Writ Petition<\/p>\n<p>is closed with liberty to the petitioner to move this Court again in case of<\/p>\n<p>occurrence of fresh cause of action.\n<\/p>\n<\/p>\n<p>                                  (C.T.
