Justice PIUS C.KURIAKOSE\n\n Dated :09\/04\/2008\n\n O R D E R\n                           PIUS.C.KURIAKOSE, J.\n                       - - - - - - - - - - - - - - - - - - - - -\n                          W.P.(c).No. 10122 OF 2008\n                   - - - - - - - - - - - - - - - - - - - - - - - - - -\n                   Dated this the 9th day of April, 2008\n\n                                 JUDGMENT\n<\/pre>\n<p>      Extensive submissions were addressed before me by Sri.V.Sajith<\/p>\n<p>Kumar, learned counsel for the petitioner, Sri.M.K.Chandramohan<\/p>\n<p>Das, learned counsel for the Pollution Control Board and Sri.G.Beno,<\/p>\n<p>counsel for the contesting party respondent. Having regard to the<\/p>\n<p>submissions and the circumstance that the petitioner has submitted<\/p>\n<p>Ext.P6 letter before the Environmental Engineer of the Pollution<\/p>\n<p>Control Board, I am of the view that if the petitioner applies to the<\/p>\n<p>Pollution Control Board formally for consent to operate the additional<\/p>\n<p>unit namely &#8220;Aswathy Wood Works Unit 2&#8221;, the 4th respondent will<\/p>\n<p>consider that application, conduct necessary local inspections and if it<\/p>\n<p>is seen that the petitioner has satisfied all the statutory requirements,<\/p>\n<p>the 4th respondent should issue consent.\n<\/p>\n<p>      Accordingly, I dispose of the writ petition without expressing any<\/p>\n<p>opinion regarding the eligibility of the petitioner to get consent for his<\/p>\n<p>additional unit. Once such application is received, the 4th respondent<\/p>\n<p><span class=\"hidden_text\">WPC.No.10122\/08                     2<\/span><\/p>\n<p>will inspect the premises with notice to the Panchayat and the petitioner<\/p>\n<p>and also Sri.N.Rajan, who has been impleaded as additional respondent<\/p>\n<p>No.6 and conduct a local inspection. After such local inspection is<\/p>\n<p>conducted, the application will be duly enquired into by the 4th<\/p>\n<p>respondent and final orders passed. Before passing final orders, the 4th<\/p>\n<p>respondent will hear the petitioner as well as the additional 6th<\/p>\n<p>respondent and call for remarks from the 5th respondent Panchayat. It<\/p>\n<p>is needless to state that consent to operate will be issued to the<\/p>\n<p>petitioner only if the 4th respondent is convinced that the unit has been<\/p>\n<p>established with consent to establish and that the pollution to be<\/p>\n<p>generated by the unit will be within the permitted levels.         In the<\/p>\n<p>meanwhile there will be a direction to the 5th respondent to ensure that<\/p>\n<p>the petitioner does not conduct the additional unit unless he is having a<\/p>\n<p>licence duly issued by the Panchayat for conducting the said unit.
