Agreement in question is Annexure P\/1 and the<br \/>\npetitioner was given the contract for plying boats on the route Gwarighat<br \/>\nto Tilwaraghat, various conditions were stipulated in the agreement. It<br \/>\nseems that while carrying out the work in accordance to the agreement,<br \/>\ncertain dispute had risen between the parties and the contract of the<br \/>\npetitioner having been terminated, this application has been filed for<br \/>\nappointment of an Arbitrator.\n<\/p>\n<p>3-            Clause 12 of the Agreement &#8211; Annexure P\/1 does<br \/>\ncontemplate an arbitration clause and it is stipulated in this clause that if<br \/>\nany dispute or difference arises in execution of the agreement, the same<br \/>\n<span class=\"hidden_text\">                                          2<\/span><\/p>\n<p>shall be settled by reference to a sole arbitrator, namely the<br \/>\nCommissioner, Jabalpur Division, Jabalpur in accordance to the<br \/>\nprovisions of the Act. It seems that during the execution of the contract,<br \/>\ncertain other contracts were given for plying of the boats in the area and<br \/>\nthere were allegations of improper maintenance of time and breach of<br \/>\nconditions by the petitioner. Even though the petitioner has refuted the<br \/>\naforesaid, facts indicate that the contract was terminated and, therefore,<br \/>\npetitioner has filed this application.\n<\/p>\n<p>4-           Having heard learned counsel for the parties and on<br \/>\nconsideration of the objections raised by the respondents, it is seen that<br \/>\nthe company in question is a registered company, having its registered<br \/>\noffice in the First Floor, Red Cross Building, Collectorate Premises,<br \/>\nJabalpur. Share capital of the company is divided between Jabalpur<br \/>\nDevelopment Authority and the Municipal Corporation, Jabalpur and it<br \/>\nseems that the Collector is one of the Directors of the Company.<br \/>\nHowever, records indicate that when the dispute had risen, petitioner had<br \/>\nsubmitted various objections to the Collector, Jabalpur and the Collector<br \/>\nby an order-dated 12.10.07 &#8211; Annexure P\/3, decided the same and<br \/>\nrejected the claim of the petitioner. Aggrieved by such rejection and by<br \/>\ncontending that his right under the Agreement is being taken away in an<br \/>\nimproper manner, petitioner had filed this application.<br \/>\n5-           Now, from the return filed by the respondent it transpires<br \/>\nthat after orders were passed by the Collector vide Annexure P\/3 on<br \/>\n12.10.07 and when the matter was pending before this Court in the<br \/>\nproceeding initiated by the petitioner under section 11 of the Act, against<br \/>\nthe order passed by the Collector, petitioner himself filed an appeal<br \/>\nbefore the Commissioner, Jabalpur Division, Jabalpur &#8211; the named<br \/>\nArbitrator as per the Agreement. This application under section 11 of the<br \/>\nAct, was filed by the petitioner before this Court on 22.1.08 and during<br \/>\nthe pendency of this application, Commissioner, Jabalpur Division has<br \/>\nconsidered the entire aspects of the matter on the appeal filed by the<br \/>\npetitioner himself before the Commissioner, who vide order-dated<br \/>\n18.3.2008 &#8211; Annexure P\/4, has recorded a finding that the order passed<br \/>\n<span class=\"hidden_text\">                                      3<\/span><\/p>\n<p>by the Collector on 12.10.07 is legal and proper, it does not warrant any<br \/>\ninterference, petitioner&#8217;s termination of contract is legal and the finding<br \/>\nof the Collector with regard to breach of contract is upheld by the<br \/>\nCommissioner.\n<\/p>\n<p>6-           Now, when the Commissioner, who himself is the named<br \/>\narbitrator in the Arbitration Agreement, has decided the issue by a<br \/>\nspeaking order-dated 18.3.2008 and when this order is passed on an<br \/>\nappeal filed by the petitioner himself, in the light of the adjudication<br \/>\nalready made, petitioner is now required to challenge the order-dated<br \/>\n18.3.2008 by resorting to the remedy available to him under law. Now,<br \/>\nthis Court cannot appoint an Arbitrator for the purpose of adjudication of<br \/>\nthe dispute as by virtue of the appeal filed by the petitioner before the<br \/>\nCommissioner himself, who is the named Arbitrator as per the<br \/>\nAgreement, a decision is rendered by the Arbitrator vide order-dated<br \/>\n18.3.2008 &#8211; Annexure P\/4, therefore, the provision of the Arbitration<br \/>\nAgreement stood exhausted and now no further reference can be made to<br \/>\nan Arbitral Tribunal for resolution of this dispute, which is already<br \/>\ndecided by the arbitrator on the basis on appeal filed by the petitioner.<br \/>\n7-           In that view of the matter, now this Court does not find any<br \/>\nground to refer the dispute to an arbitrator, as the dispute is already<br \/>\nadjudicated by an authority, which is the named arbitrator in the<br \/>\nagreement.\n<\/p>\n<p>8-           Accordingly, finding no case for appointing an arbitrator<br \/>\nnow in these proceedings, this application is dismissed with liberty to the<br \/>\npetitioner to assail the order passed by the Commissioner, Jabalpur<br \/>\nDivision, Jabalpur vide order-dated 18.3.2008 &#8211; Annexure P\/4 in<br \/>\naccordance with law before an appropriate authority or forum.<br \/>\n9-           Application stands dismissed with the aforesaid liberty.\n<\/p>\n<p>                                            ( RAJENDRA MENON )<br \/>\n                                                   JUDGE<br \/>\nAks\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Kishan Mallah vs Jabalpur City Transport Service &#8230; on 21 September, 2010 HIGH COURT OF MADHYA PRADESH : AT JABALPUR Arbitration Case No : 8 of 2008 Kishan Mallah &#8211; V\/s &#8211; Jabalpur City Transport Services Ltd.
