Justice ANTONY DOMINIC\n\n Dated :05\/11\/2007\n\n O R D E R\n                   ANTONY DOMINIC, J.\n\n            = = = = = = = = = = = = = = = =\n              W.P.(C) No. 30768 OF 2007 K\n            = = = = = = = = = = = = = = = =\n\n           Dated this the 5th November, 2007\n\n                    J U D G M E N T\n<\/pre>\n<p>    This writ petition has been filed by a toll<\/p>\n<p>contractor praying for a direction to respondents 2 to<\/p>\n<p>4 to repair the toll bar and beam attached to toll<\/p>\n<p>booth in Kavankallu Regulator cum bridge within a time<\/p>\n<p>frame fixed by this Court.      There is an alternate<\/p>\n<p>prayer  that  if  the  repair  as  prayed  for  is  not<\/p>\n<p>possible, the bid amount with compensation may be<\/p>\n<p>directed to be returned to the petitioner.<\/p>\n<p>    2.  On  the   direction  of  this  Court,  the  4th<\/p>\n<p>respondent has filed a statement in which it has been<\/p>\n<p>stated that the respondents have taken effective steps<\/p>\n<p>to remove the existing old cross bar and to erect a new<\/p>\n<p>one.  It is also stated that for getting the aforesaid<\/p>\n<p>work executed a tender has been awarded to one Mohammed<\/p>\n<p>Ali, E. and in terms of the conditions of such award,<\/p>\n<p>the contractor is required to complete the entire work<\/p>\n<p>within six months from 4-9-2007 when the site has been<\/p>\n<p><span class=\"hidden_text\">WPC No. 30768\/07            -2-<\/span><\/p>\n<p>handed over to the contractor.        According to the<\/p>\n<p>respondents it is only on account of heavy rains that<\/p>\n<p>the contractor could not commence the work.<\/p>\n<p>    3. In view of the effective steps that have been<\/p>\n<p>taken by the respondents for getting the works executed<\/p>\n<p>I see no necessity for issuing a further direction<\/p>\n<p>regarding the awarding of work.    However, the work has<\/p>\n<p>to be completed expeditiously, particularly since the<\/p>\n<p>contract period of the petitioner is expiring soon as<\/p>\n<p>otherwise he will be loosing heavily.
