No.73 Of 2007\n                    = = = = = = = = = = = = = =\n\n               Dated this the 27th day of September, 2007\n\n                                 ORDER\n<\/pre>\n<p>      The petitioners face indictment in      a prosecution, inter alia,<\/p>\n<p>under Sections 406 and 420 IPC. The proceedings are pending before<\/p>\n<p>the Judicial First Class Magistrate Court- Vaikom. Consequent to<\/p>\n<p>nonappearance of the petitioners before the learned Magistrate<\/p>\n<p>warrants of arrest have been issued against the petitioners by the<\/p>\n<p>learned Magistrate. The petitioners have now come before this Court<\/p>\n<p>with a prayer that the case against them pending before the Judicial<\/p>\n<p>First Class Magistrate Court- Vaikom may now be transferred to any<\/p>\n<p>other court at Thrissur, their native place.\n<\/p>\n<p>      2. What is the reason? The learned counsel for the petitioners<\/p>\n<p>submits that the 1st petitioner is afflicted with diseases and finds it<\/p>\n<p>difficult to proceed to Vaikom to attend the trial. Ilness of one of the<\/p>\n<p>petitioners is the sole ground on which the transfer is sought.<\/p>\n<p>      3. The learned Public Prosecutor stoutly opposes the application.<\/p>\n<p>It would be unjust and unfair to compel all the witness to proceed all<\/p>\n<p>the way to Thrissur to attend the trial only to satisfy the convenience<\/p>\n<p>of the petitioners.   It is for the petitioners to surrender before the<\/p>\n<p>Court at Vaikom, to seek bail afresh and file appropriate applications<\/p>\n<p>TPCR No. 73 of 2007<br \/>\n<span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>seeking exemption under Section 317 Cr.P.C. Instead of doing that<\/p>\n<p>they have rushed to this Court with this prayer to transfer the case.<\/p>\n<p>It is obviously with an intention to delay or protract the proceedings,<\/p>\n<p>submits the learned Public Prosecutor.\n<\/p>\n<p>      4. I find absolutely no relevant circumstances urged before the<\/p>\n<p>court to justify the prayer for transfer. The prayer therefore deserves<\/p>\n<p>to be rejected. The illness of one of the petitioners is only a vague<\/p>\n<p>allegation. It is certainly not sufficient to justify the prayer for transfer<\/p>\n<p>the case from Vaikom to Thrissur. This transfer petition is in these<\/p>\n<p>circumstances dismissed.\n<\/p>\n<p>      5.   The learned counsel for the petitioners submits that the<\/p>\n<p>petitioners apprehend that their applications for bail may not be<\/p>\n<p>considered on merits, in accordance with law and expeditiously, when<\/p>\n<p>they surrender before the learned Magistrate. I have no reason to<\/p>\n<p>assume that the learned Magistrate would not consider such<\/p>\n<p>applications on merits, in accordance with law and expeditiously. Every<\/p>\n<p>court must do the same. No special or specific direction appears to be<\/p>\n<p>necessary. Sufficient general directions have already been issued in<\/p>\n<p><a href=\"\/doc\/147290035\/\">Alice George v. The Deputy Superintendent of Police<\/a> [2003(1)<\/p>\n<p>KLT 339]. If they surrender, the learned Magistrate must proceed to<\/p>\n<p>pass appropriate orders on merits and expeditiously &#8211; on the date of<\/p>\n<p>TPCR No. 73 of 2007<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>surrender itself.\n<\/p>\n<p>      6.   The learned counsel for the petitioners submits that if<\/p>\n<p>personal appearance of the petitioners were insisted on all dates of<\/p>\n<p>postings, it would cause irreparable loses and hardship to the<\/p>\n<p>petitioners.  The learned counsel for the petitioners submits that until<\/p>\n<p>the case reaches at the stage of 313 examination, no personal<\/p>\n<p>appearance is necessary.      I have no reason to assume that the<\/p>\n<p>petitioners&#8217; application for exemption would not be considered by the<\/p>\n<p>learned Magistrate on merits, in accordance with law. Every court<\/p>\n<p>must do the same.
