Raval,  learned Additional Public Prosecutor waives service<br \/>\nof rule on  behalf of the respondent-State.\n<\/p>\n<p>3.\tThe<br \/>\napplicant- appellant- original accused has been convicted for the<br \/>\noffence punishable under section 302 of the Indian Penal Code to<br \/>\nsuffer imprisonment for life with fine of Rs.500\/-, in default to<br \/>\nfurther undergo imprisonment for 1 month by the learned City Sessions<br \/>\nJudge, Ahmedabad in Sessions Case No.126 of 2005.\n<\/p>\n<p>4.\tThe learned<br \/>\nAPP has made available the Jail record.   Nothing adverse is noticed<br \/>\nin the Jail remarks except some minor lapses on the part of the<br \/>\napplicant- convict. The convict has undergone 6 years, 5 months and 4<br \/>\ndays in Jail as on 23rd March 2011.  The convict had<br \/>\navailed furlough thrice and temporary bail once.\n<\/p>\n<p>5.\tTaking into<br \/>\nconsideration the contents of the application and the record of the<br \/>\nconvict, the convict is ordered to be released on  temporary<br \/>\nbail for 20 (twenty) days from the date of his release on his<br \/>\nexecuting a personal bond of Rs.5000\/- (Rupees five thousand only) to<br \/>\nthe satisfaction of the Jail authorities.\n<\/p>\n<p>6.\tThe<br \/>\napplicant- convict shall surrender himself to the Jail authorities on<br \/>\nexpiry of the above temporary bail period.\t  The application is<br \/>\nallowed.
