Justice S.S.SATHEESACHANDRAN\n\n Dated :31\/05\/2010\n\n O R D E R\n        THOTTATHIL B.RADHAKRISHNAN\n         &amp; S.S.SATHEESACHANDRAN, JJ.\n        ---------------------------------------\n               W.P.(C).No.13226 of 2010\n        ---------------------------------------\n       Dated this the 31st day of May, 2010\n\n                     JUDGMENT\n<\/pre>\n<p>THOTTATHIL B.RADHAKRISHNAN, J.<\/p>\n<p>         The petitioner applied for the post of<\/p>\n<p>Grama Dak Sevak Mail Deliverer of Chempazhanthi<\/p>\n<p>Post Office.  The qualification prescribed is 8th<\/p>\n<p>standard, preference to be given to candidates<\/p>\n<p>with matriculation.       The petitioner possesses<\/p>\n<p>only the qualification of 8th standard.        There is<\/p>\n<p>only one post.    The notification was issued in<\/p>\n<p>terms   of    the     prescribed       qualifications.<\/p>\n<p>Thereafter,   the    establishment       invited    for<\/p>\n<p>interview, only those candidates who possessed<\/p>\n<p>matriculation.    Admittedly,      as    against    one<\/p>\n<p>vacancy,  there     were    sufficient      number   of<\/p>\n<p>candidates, among matriculates.         The petitioner<\/p>\n<p>challenged his exclusion from interview.            The<\/p>\n<p>Tribunal  was   not    impressed      to   uphold   the<\/p>\n<p>petitioner&#8217;s contention.\n<\/p>\n<p>W.P.(C).No.13226 of 2010<\/p>\n<p>                        :: 2 ::\n<\/p>\n<\/p>\n<p>         2.      The   learned    counsel  for the<\/p>\n<p>petitioner argued that the impugned action of<\/p>\n<p>the   establishment      amounts     to   wholesale<\/p>\n<p>reservation in favour of a category among those<\/p>\n<p>in  the  field    of   choice    in  terms  of the<\/p>\n<p>recruitment rules.    What has been done is not a<\/p>\n<p>reservation, but is only weeding out those who<\/p>\n<p>would be away from the priority by application<\/p>\n<p>of the preference to be given to matriculate. It<\/p>\n<p>is not a case where the Department has isolated<\/p>\n<p>the petitioner.     They have applied a yardstick<\/p>\n<p>of weeding out those who were not matriculates.<\/p>\n<p>Matriculation being the preferred qualification,<\/p>\n<p>we do not find any illegality or error of<\/p>\n<p>jurisdiction in the Tribunal having affirmed the<\/p>\n<p>action of the establishment.        We are also not<\/p>\n<p>impressed   with     the     contention  that  the<\/p>\n<p>petitioner&#8217;s case is covered by the decision of<\/p>\n<p>this court in <a href=\"\/doc\/1125417\/\">Minimol v. Sree Sankaracharya<\/p>\n<p>University of Sanskrit<\/a> {2010 (1) KLT 74}.      That<\/p>\n<p>issue   related    to   an     action  whereby the<\/p>\n<p> W.P.(C).No.13226 of 2010<\/p>\n<p>                           :: 3 ::\n<\/p>\n<p>\nUniversity    excluded     persons     with very hgh<\/p>\n<p>qualifications from being considered at par with<\/p>\n<p>those who had the &#8220;ability to read and write&#8221;.<\/p>\n<p>This court took the view that to push forward<\/p>\n<p>those who have only the &#8220;ability to read and<\/p>\n<p>write&#8221; in public employment, the University had<\/p>\n<p>acted fairly in excluding those with higher<\/p>\n<p>qualifications.
