RADHAKRISHNAN, J.\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n            W.P.(C).No.30294 of 2008-F\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n     Dated this the 16th day of October, 2008.\n\n                     JUDGMENT\n<\/pre>\n<p>1.Adv.Smt.P.Vijayamma takes notice for the first<\/p>\n<p> respondent.\n<\/p>\n<\/p>\n<p>2.The petitioner availed a loan from the first<\/p>\n<p> respondent. According to him, he could not run<\/p>\n<p> the brick manufacturing unit even for a day<\/p>\n<p> utilizing that loan. This is no excuse for the<\/p>\n<p> petitioner when he is called upon to repay the<\/p>\n<p> amounts   due  under  the  loan  transaction.   It<\/p>\n<p> appears that he had approached this Court earlier<\/p>\n<p> also and ultimately suffered an arbitration award<\/p>\n<p> which was carried to the Co-operative Tribunal.<\/p>\n<p> Even then, amounts were not paid. Ultimately, the<\/p>\n<p> bank was forced to take action under the SARFAESI<\/p>\n<p> Act and has issued dispossession notice under<\/p>\n<p><span class=\"hidden_text\">WP(C)30294\/08         -: 2 :-<\/span><\/p>\n<p> Section 13(4). In spite of the fact that there is<\/p>\n<p> no jurisdictional error or legal infirmity in the<\/p>\n<p> impugned proceedings, the learned senior counsel<\/p>\n<p> for the petitioner submitted that the petitioner<\/p>\n<p> gives up all contentions, including the right to<\/p>\n<p> move statutory Tribunals or other authorities<\/p>\n<p> against the impugned proceedings and prays that<\/p>\n<p> he may be granted an opportunity to wipe off the<\/p>\n<p> outstandings   and that      having  regard  to the<\/p>\n<p> totality of the facts and circumstances, the bank<\/p>\n<p> may be directed to grant a reduction in the total<\/p>\n<p> outstandings.\n<\/p>\n<p> Having regard to the facts and circumstances,<\/p>\n<p> this writ petition is ordered, repelling all<\/p>\n<p> other contentions, however directing that if the<\/p>\n<p> petitioner remits an amount of Rs.7 lakhs within<\/p>\n<p> one month and continues to remit at the rate of<\/p>\n<p> Rs.3 lakhs per month payable on or before the 15th<\/p>\n<p> of every month commencing from December, 2008,<\/p>\n<p> the impugned distress action will be held back.<\/p>\n<p> On    deposit of  four      instalments,  the  first<\/p>\n<p><span class=\"hidden_text\">WP(C)30294\/08          -: 3 :-<\/span><\/p>\n<p> respondent    will  consider   any  request  of  the<\/p>\n<p> petitioner      for  reduction     in   the    total<\/p>\n<p> outstandings and if such request is acceded to<\/p>\n<p> any extent, that shall be given effect to while<\/p>\n<p> receiving last two instalments.      The time fixed<\/p>\n<p> above shall be treated as peremptory and shall<\/p>\n<p> not    be   extended.    If   there is   default in<\/p>\n<p> remitting any of the instalments as aforesaid,<\/p>\n<p> the benefits of this judgment will be recalled<\/p>\n<p> and     the   writ  petition    will  be   dismissed<\/p>\n<p> automatically enabling the first respondent to<\/p>\n<p> forthwith proceed with further distress action<\/p>\n<p> without fresh notice to the petitioner.<\/p>\n<p>                        THOTTATHIL B.
