to file his written statement. Inspite “of giving sufficient<\/p>\n

below passed the impugned judgment and decree,<\/p>\n

averments. Hence the present appeai by the defendant.\n<\/p>\n
4. Sri’.Mohan, the learned Counsel appearingtfor<\/p>\n

  the defendant and the non–fEling of the<\/p>\n

 Srisrinvasan, the learned Counsel appearing<\/p>\n
for the respondent–plaintiff contends that the defendant<\/p>\n

has deliberateiy not attended the Court. The trial Court
\nhas passed a just and reasonabie order. He further<\/p>\n
submits that the suit was fiied as far as back in tb.e:’~y’eavr<\/p>\n
2002 and the amount due to the plaintiff <\/p>\n
been paid by the defendant.\n<\/p>\n

 On merits the contention of the appellant is<\/p>\n
   __that he is not liable to pay any amount. He contends that<\/p>\n
there is evidence and material to show that the entire<\/p>\n

given an opportunity he would establish his case before<\/p>\n
