No.7085 of 2011\n                                 JITENDRA SWAMI\n                                          Versus\n                               THE STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p>7\/   27.4.2011             Heard.\n<\/p>\n<p>                           By its order dated 18.3.2011, the court had applied its own<\/p>\n<p>                 option for getting the petitioner checked up by Dr. Virendra Prasad<\/p>\n<p>                 Sinha (Dr. V.P. Sinha), who was informed to be Associate<\/p>\n<p>                 Professor, Cardiology Department, PMCH, Patna and direction in<\/p>\n<p>                 that behalf were clearly issued by that particular order.<\/p>\n<p>                           It appears that in pursuance to that order of this Court, the<\/p>\n<p>                 petitioner was produced before Dr. Sinha and, accordingly, he was<\/p>\n<p>                 admitted in his ward for carrying out the tests as per direction of this<\/p>\n<p>                 Court and, lastly, after fully affiliating the health conditions of the<\/p>\n<p>                 petitioner, the petitioner was discharged on 4.4.2011. Dr. Sinha has<\/p>\n<p>                 submitted his report in an envelope, which is available at Flag &#8211; \u201eH\u201f<\/p>\n<p>                 and it appears from the prescriptions, which contains the advice, that<\/p>\n<p>                 &#8220;in view of PTCA re-evaluation of Stent for thrombosis\/closure is<\/p>\n<p>                 needed so evaluation should be done at AIIMS, CTVS Deptt., New<\/p>\n<p>                 Delhi&#8221;.\n<\/p>\n<p>                           In the light of the above advice, it is desirable that the<\/p>\n<p>                 petitioner should be shifted under proper escort at the cost of the<\/p>\n<p>                 State Government from District Jail, Siwan to the concerned<\/p>\n<p>                 Department\/Ward of the department for evaluation at convenient<\/p>\n<p>                 time and not beyond fifteen days of the receipt of the copy of the<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>        present order. The doctors, who could be carrying out the tests in<\/p>\n<p>        AIIMS, if necessary, shall admit the petitioner for necessary check-<\/p>\n<p>        up and tests and after treating the petitioner in a maximum period of<\/p>\n<p>        one week, as per the requirement of his health conditions, shall<\/p>\n<p>        discharge him whereafter the petitioner shall be lodged again in<\/p>\n<p>        District Jail, Siwan. It may be pointed out to all concerned that no<\/p>\n<p>        undue delay in taking the petitioner to AIIMS, New Delhi and<\/p>\n<p>        bringing him back to Siwan Jail shall be made by any one who could<\/p>\n<p>        be concerned or had the duty to comply the present order. No doctor<\/p>\n<p>        shall keep the petitioner for any period more than could be required.<\/p>\n<p>                   In the light of the above order, the learned senior counsel<\/p>\n<p>        Shri Rajendra Prasad Singh, seeks to withdraw the petition on<\/p>\n<p>        account of the fulfillment of the purpose of filing the petition with<\/p>\n<p>        liberty that, he will be filing a fresh petition, if need be, in future.<\/p>\n<p>                   This petition stands dismissed as withdrawn with the<\/p>\n<p>        above direction on compliance of the present order.<\/p>\n<p>                   Let a copy of the present order be transmitted to the trial<\/p>\n<p>        court, i.e., Additional Sessions Judge &#8211; I, Siwan through Fax, who<\/p>\n<p>        will inform all concerned by enclosing a copy of the present order.<\/p>\n<pre>Anil\/                                      ( Dharnidhar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Jitendra Swami vs The State Of Bihar on 27 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
