(ORAL)\n<\/pre>\n<p>            This writ petition under Article 226\/227 of the Constitution of<\/p>\n<p>India is directed against the issuance of charge sheet attached as Annexure<\/p>\n<p>P-13 and the order of suspension passed by the Director Education,<\/p>\n<p>Shiromani Gurudwara Parbhandak Committee, 6-Kalidhar Niwas, Sector<\/p>\n<p>27-B, Chandigarh and Nankana Sahib Education Trust, Gill Park, Ludhiana,<\/p>\n<p>through its President.\n<\/p>\n<p>            Paras 3 &amp; 4 of the writ petition read as under :-\n<\/p>\n<blockquote><p>                          &#8220;3. That it may not be out of<br \/>\n                          place     to    mention        here        that<br \/>\n                          Nankana Sahib Education Trust-<br \/>\n                          Respondent        No.3    is     a       Trust<br \/>\n                          which was created in the year<br \/>\n                          1954     with    object     to    provide<br \/>\n                          all types of Engineering and<br \/>\n<span class=\"hidden_text\"> CWP No. 18235 of 2009                                                    2<\/span><\/p>\n<p>                    Scientific           Education                 and<br \/>\n                    Training        to         the        weaker,<br \/>\n                    backward and poor sections of<br \/>\n                    the    Society        with       particular<br \/>\n                    emphasis on rural candidates.<br \/>\n                    The    President           of     Shiromani<br \/>\n                    Gurdwara Prabhandak Committee<br \/>\n                    (constituted               under               the<br \/>\n                    provisioins of Sikh Gurdwaras<br \/>\n                    Act.        1925)        is      ex-officio<br \/>\n                    President       of       the      Education<br \/>\n                    Trust-respondent No.3. Besides<br \/>\n                    this there are other posts of<br \/>\n                    Vice Presidents, Secretary and<br \/>\n                    9 Members of SGPC out of total<br \/>\n                    16    are    appointed          by    General<br \/>\n                    Body    of     SGPC       besides          other<br \/>\n                    trustees      of     the      said        trust.<br \/>\n                    Thus SGPC has complete control<br \/>\n                    over    the     institutions               being<br \/>\n                    run by the Trust. The Managing<br \/>\n                    Committee       of       and      Education<br \/>\n                    Institution                could                be<br \/>\n                    constituted         by     the       Board      of<br \/>\n                    Trustees.            The          provision<br \/>\n                    regarding       office          holders        of<br \/>\n                    the    Managing          Committee             are<br \/>\n                    mentioned      under          Para        10    of<br \/>\n                    Clause VII of the Trust Rules,<br \/>\n                    which can be produced at the<br \/>\n                    time of hearing if directed by<br \/>\n                    the    Hon&#8217;ble        Bench.         However,<br \/>\n                    the    aforesaid         para        10    being<br \/>\n                    relevant      is     reproduced            below<br \/>\n<span class=\"hidden_text\"> CWP No. 18235 of 2009                                                  3<\/span><\/p>\n<p>                    for ready reference :-<br \/>\n                    (VII)(10)             Office Holders of<br \/>\n                    the Managing Committee :\n<\/p><\/blockquote>\n<blockquote><p>                    (a) The         President            of     the<br \/>\n                    Board shall be the ex-officio<br \/>\n                    Chairman         of        every     Managing<br \/>\n                    Committee appointed under this<br \/>\n                    instrument.           He    shall     preside<br \/>\n                    and perform such other duties<br \/>\n                    as are entrusted to him by the<br \/>\n                    rules and regulations.\n<\/p><\/blockquote>\n<pre>                    (b) Every                          Management\n                    Committee         shall        elect        one\n<\/pre>\n<blockquote><p>                    Vice-Chairman from amongst its<br \/>\n                    members      who           shall      perform<br \/>\n                    duties      of        Chairman       in     his<br \/>\n                    absence.\n<\/p><\/blockquote>\n<pre>                    (c) The          Principal           of      an\n                    institution           managed        by      the\n<\/pre>\n<blockquote><p>                    Trust shall be the Secretary<br \/>\n                    of the Managing Committee of<br \/>\n                    that institution and he shall<br \/>\n                    perform     such           duties     as     are<br \/>\n                    entrusted to him by the rules<br \/>\n                    made by the Managing Committee<br \/>\n                    and approved by the Board.\n<\/p><\/blockquote>\n<blockquote><p>                    4.   That         respondent               No.2-<\/p><\/blockquote>\n<pre>\n                    Trust      is         running         amongst\n                    others          Guru          Nanak         Dev\n                    Engineering                 College          at\n                    Ludhiana          besides             running\n                    Nankana     Sahib          Public     School,\n                    Ludhiana     where          petitioner       is\n<\/pre>\n<blockquote><p>                    teaching. The said School is<br \/>\n<span class=\"hidden_text\"> CWP No. 18235 of 2009                                                4<\/span><\/p>\n<p>                    not receiving any grant from<br \/>\n                    the Punjab Govt. The service<br \/>\n                    conditions of the employees of<br \/>\n                    Nankana Sahib Public School a<br \/>\n                    re governed by the rules known<br \/>\n                    as     Nankana        Sahib     Education<br \/>\n                    Trust Public School Employees<br \/>\n                    Rules,      relevant           provisions<br \/>\n                    which are reproduced below for<br \/>\n                    ready reference :-\n<\/p><\/blockquote>\n<blockquote><p>                    Rule 1 :          These rules shall<br \/>\n                    be known as the Nankana Sahib<br \/>\n                    Education Trust Public School<br \/>\n                    Employees Rules.\n<\/p><\/blockquote>\n<blockquote><p>                    Rule 6 :          All     appointments<br \/>\n                    of all categories of employees<br \/>\n                    are     made     by      the        Managing<br \/>\n                    Committee        either        by    direct<br \/>\n                    recruitment       or     by     promotion<br \/>\n                    and    in   accordance          with       and<br \/>\n                    upon     such    condition          as     the<br \/>\n                    Managing Committee may decide.\n<\/p><\/blockquote>\n<pre>                    Rule 12 :         The               Managing\n                    Committee       may     terminate          the\n<\/pre>\n<blockquote><p>                    service of an employee, after<br \/>\n                    he\/she      is         confirmed           for<br \/>\n                    reasons          of       retrenchment<br \/>\n                    because     of        abolition       of     a<br \/>\n                    subject, class or department,<br \/>\n                    after giving such an employee<br \/>\n                    three months notice, provided<br \/>\n                    however, that such an employee<br \/>\n                    shall receive as compensation<br \/>\n                    as many month&#8217;s pay for those<br \/>\n<span class=\"hidden_text\"> CWP No. 18235 of 2009                                                5<\/span><\/p>\n<p>                    who have served for more than<br \/>\n                    twelve years.\n<\/p><\/blockquote>\n<blockquote><p>                    Rule 15 :         The service of a<br \/>\n                    permanent       employee            may     be<br \/>\n                    terminated         on         grounds       of<br \/>\n                    insubordination                to          the<br \/>\n                    Management        or     Principal          or<br \/>\n                    Headmistress. Inefficiency in<br \/>\n                    his\/her work, neglect of duty<br \/>\n                    assigned            to              him\/her,<br \/>\n                    misconduct, moral delinquency,<br \/>\n                    contagious disease or for any<br \/>\n                    other     cause     which        make      the<br \/>\n                    employee           unsuitable              or<br \/>\n                    undesirable       for     retention         in<br \/>\n                    service, provided that before<br \/>\n                    such termination is made due<br \/>\n                    enquiry     committee            appointed<br \/>\n                    for the purpose. The enquiry<br \/>\n                    committee shall consist of the<br \/>\n                    Secretary         and         two       other<br \/>\n                    representatives                of          the<br \/>\n                    Management.             Before            such<br \/>\n                    enquiry is held, the secretary<br \/>\n                    shall     obtain        the     employee&#8217;s<br \/>\n                    explanation        on     the        charges<br \/>\n                    made    against        him\/her.       During<br \/>\n                    the enquiry the employee shall<br \/>\n                    be         given                reasonable<br \/>\n                    opportunity of being heard in<br \/>\n                    respect    of     the     charges         made<br \/>\n                    against     him\/her            to     defend<br \/>\n                    himself by means of a written<br \/>\n                    statement as well as leading<br \/>\n<span class=\"hidden_text\"> CWP No. 18235 of 2009                                                     6<\/span><\/p>\n<p>                    evidence, if any. In case the<br \/>\n                    employee        does        not          present<br \/>\n                    himself       before           the        enquiry<br \/>\n                    committee          after       due           notice<br \/>\n                    sent          by          Regd.               Post<br \/>\n                    acknowledgment             due,           exparte<br \/>\n                    decision will be given by the<br \/>\n                    enquiry committee, which shall<br \/>\n                    be binding on the employee.\n<\/p><\/blockquote>\n<blockquote><p>                           If after such enquiry the<br \/>\n                    decision           of      the            Enquiry<br \/>\n                    Committee is to be effect that<br \/>\n                    it is undesirable to continue<br \/>\n                    his\/her      services          or        that    he<br \/>\n                    may     be         awarded           a        lower<br \/>\n                    punishment         including             a    fine,<br \/>\n                    ensure,            withholding                   of<br \/>\n                    increments for not more than 2<br \/>\n                    stages,         loss           caused            by<br \/>\n                    negligence or breach of orders<br \/>\n                    of      the          management                 and<br \/>\n                    department,              the         Secretary<br \/>\n                    shall    propose         to     impose          any<br \/>\n                    penalty including termination<br \/>\n                    of service and give him or her<br \/>\n                    reasonable              opportunity              of<br \/>\n                    making representations on the<br \/>\n                    penalty proposed, but only on<br \/>\n                    the     basis       of     the           evidence<br \/>\n                    produced during such enquiry.\n<\/p><\/blockquote>\n<pre>                           The         management                 shall\n                    after          considering                    such\n                    representation             made          by     the\n<\/pre>\n<blockquote><p>                    employee impose any penalty as<br \/>\n<span class=\"hidden_text\"> CWP No. 18235 of 2009                                                      7<\/span><\/p>\n<p>                        it deems fit which shall be<br \/>\n                        binding on the employees and a<br \/>\n                        copy      of       the     order        by     a<br \/>\n                        resolution          of   the     management<br \/>\n                        shall be communicated to the<br \/>\n                        employee within 7 days.\n<\/p><\/blockquote>\n<pre>                        Rule 17 :           It          shall        be\n                        competent      for       the     management\n<\/pre>\n<blockquote><p>                        to suspend the teacher during<br \/>\n                        the course of the enquiry but<br \/>\n                        the     teacher          may     be     given<br \/>\n                        subsistence          allowance        at     the<br \/>\n                        scale       that          is      generally<br \/>\n                        applied        to        Govt.     servants<br \/>\n                        during         the             period        of<br \/>\n                        suspension.&#8221;\n<\/p><\/blockquote>\n<p>             The reading of the pleadings, referred to above, would show<\/p>\n<p>that the college being run by the Nankana Sahib Education Trust, which is<\/p>\n<p>a Trust registered by the trustees of the college. With passage of time<\/p>\n<p>certain amendments have been made. The constitution of the Nankana<\/p>\n<p>Sahib Education Trust shows that respondent No.3, which is running the<\/p>\n<p>college cannot be said to be within the Article 12 of the Constitution of<\/p>\n<p>India, therefore, this writ petition against the Trust or college is not<\/p>\n<p>competent.\n<\/p>\n<p>             Dismissed as not competent.<\/p>\n<pre>\n\n\n\n2.12.2009                                         ( VINOD K.
