Sahai\n\nHon'ble Vineet Saran,J.\n<\/pre>\n<p>Hon&#8217;ble Ran Vijai Singh,J.\n<\/p>\n<p>Heard learned counsel for the petitioner as well as learned<br \/>\nStanding Counsel appearing for respondents no. 1 to 3 and Sri S.D.<br \/>\nSahai for the contesting respondent no. 4-Central Bank of India<br \/>\nand have perused the record. With consent of the learned counsel<br \/>\nfor the parties, this writ petition is being disposed of at this stage<br \/>\nwithout calling for a counter affidavit.\n<\/p>\n<p>The petitioner had taken a loan from the respondent-Bank in the<br \/>\nyear 2005. Since there was default in payment of regular<br \/>\ninstallments, the recovery certificate dated 31.12.2009 for an<br \/>\namount of Rs. 1,47,739\/- plus interest and other charges has been<br \/>\nissued against the petitioner. Challenging the same, this writ<br \/>\npetition has been filed. Learned counsel for the petitioner states<br \/>\nthat the petitioner is ready and willing to pay the entire amount due<br \/>\nfrom him, for which easy installments may be fixed by the Bank.\n<\/p>\n<p>Learned counsel for the respondent-Bank states that in case if the<br \/>\npetitioner deposits about one fourth of the amount within six<br \/>\nweeks from today with the Bank, the respondent-Bank would be<br \/>\nprepared to reschedule the repayment of the balance amount in<br \/>\neasy installments.\n<\/p>\n<p>Accordingly, with consent of the learned counsel for the parties,<br \/>\nthis writ petition is finally disposed of with the direction that in<br \/>\n case if the petitioner deposits a sum of Rs. 25,000\/- within six<br \/>\nweeks from today with the respondent-Bank and files an<br \/>\napplication for fixation of installment of balance amount of loan,<br \/>\nthe said application of the petitioner shall be considered<br \/>\nsympathetically and the bank shall fix six equal installments<br \/>\nspread over 18 months for payment of the balance amount which<br \/>\nthe petitioner undertakes to pay. In case, if the petitioner deposits<br \/>\nthe amount, as indicated above, the recovery citation issued against<br \/>\nthe petitioner shall remain in abeyance. However, in case of<br \/>\ndefault of any of the installments, the recovery citation issued by<br \/>\nthe Tehsildar shall stand automatically revived. If the payment is<br \/>\nmade directly to the Bank, the State-authorities shall not realize<br \/>\nany collection charges.\n<\/p>\n<p>With the aforesaid observations\/ directions, this writ petition is<br \/>\nfinally disposed of.
