Justice K.T.SANKARAN\n\n Dated :05\/06\/2009\n\n O R D E R\n                      K.T.SANKARAN, J.\n\n               -----------------------------------------\n                       B.A.No. 2932 of 2009\n               -----------------------------------------\n\n                Dated this the 5th June, 2009\n\n                            O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under Section<\/p>\n<p>438 of the Code of Criminal Procedure. The petitioners are<\/p>\n<p>accused 2 to 7 in Crime No.755\/09 of Kalamassery Police<\/p>\n<p>Station.\n<\/p>\n<p>      2. The offences alleged against the petitioners are under<\/p>\n<p>Sections 409, 498A and 34 of the Indian Penal Code and<\/p>\n<p>Sections 2 and 4 of the Dowry Prohibition Act.<\/p>\n<p>      3. The marriage between the de facto complainant and<\/p>\n<p>the first accused took place on 4.9.2005. I have perused a copy<\/p>\n<p>of the complaint which was made available to me by the<\/p>\n<p>learned counsel appearing for the de facto complainant. There<\/p>\n<p>are allegations of demand for dowry in the years 2005 and<\/p>\n<p>2006. According to the petitioners, the first accused (husband)<\/p>\n<p>and the de facto complainant are residing separately since<\/p>\n<p>2007. The first accused is employed abroad. There is no case<\/p>\n<p><span class=\"hidden_text\">   BA.2932\/09                    2<\/span><\/p>\n<p>for anybody that the de facto complainant was residing with<\/p>\n<p>the petitioners at any time after 2007. The first petitioner is<\/p>\n<p>the father-in-law, second petitioner is the mother-in-law, third<\/p>\n<p>petitioner is the sister-in-law and the fourth petitioner is the<\/p>\n<p>husband of the sister-in-law of the de facto complainant. Fifth<\/p>\n<p>petitioner is the brother-in-law of the de facto complainant and<\/p>\n<p>6th petitioner is the wife of the 5th petitioner. The husband<\/p>\n<p>(first accused) is still employed abroad. He has pronounced<\/p>\n<p>Thalaq and it was intimated the de facto complainant.<\/p>\n<p>      4. The learned counsel for the petitioners submitted that<\/p>\n<p>the petitioners apprehend arrest and humiliation and<\/p>\n<p>harassment. He pointed out that the father of the de facto<\/p>\n<p>complainant is a retired Colonel and the complaint was filed<\/p>\n<p>before the Assistant Commissioner of Police, Kochi, which was<\/p>\n<p>forwarded to the Kalamassery Police Station and the crime<\/p>\n<p>was registered.\n<\/p>\n<p>      5. The learned counsel appearing for the de facto<\/p>\n<p>complainant submitted that there are lot of contradictions in<\/p>\n<p>the statement of facts in the bail application and the<\/p>\n<p><span class=\"hidden_text\">  BA.2932\/09                      3<\/span><\/p>\n<p>statements in the letter intimating Thalaq and the two stories<\/p>\n<p>will not stand together. I do not think that it is necessary to<\/p>\n<p>consider the disputed questions of facts for the purpose of<\/p>\n<p>deciding this application for anticipatory bail.<\/p>\n<p>      6.    Taking into account the facts and circumstances of<\/p>\n<p>the case, the nature of the offences and other circumstances, I<\/p>\n<p>am of the view that anticipatory bail can be granted to the<\/p>\n<p>petitioners. There will be a direction that in the event of the<\/p>\n<p>arrest of the petitioners, the officer in charge of the police<\/p>\n<p>station shall release them on bail for a period of one month on<\/p>\n<p>their executing bond for Rs.50,000\/- each with two solvent<\/p>\n<p>sureties for the like amount to the satisfaction of the officer<\/p>\n<p>concerned, subject to the following conditions:<\/p>\n<blockquote><p>      A)        Petitioner No.5 shall report before the<\/p>\n<p>                 investigating officer between 9 AM and 11<\/p>\n<p>                 AM on all Mondays, till the final report is<\/p>\n<p>                 filed or until further orders;<\/p>\n<p>      B)         The petitioners shall appear before the<\/p>\n<p>                 investigating officer for interrogation as<\/p>\n<p>                 and when required;\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\"> BA.2932\/09                     4<\/span><\/p>\n<p>     C)      The petitioners shall not try to influence the<\/p>\n<p>              prosecution witnesses or tamper with the<\/p>\n<p>              evidence;\n<\/p><\/blockquote>\n<blockquote><p>     D)      The petitioners shall not commit any offence<\/p>\n<p>              or indulge in any prejudicial activity while<\/p>\n<p>              on bail.\n<\/p><\/blockquote>\n<blockquote><p>     E)       On the    expiry of the period mentioned<\/p>\n<p>              above, the petitioners shall surrender<\/p>\n<p>              before the Magistrate concerned and seek<\/p>\n<p>              regular bail.\n<\/p><\/blockquote>\n<blockquote><p>     F)       In case of breach of any of the conditions<\/p>\n<p>              mentioned above, the bail shall be liable to<\/p>\n<p>              be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>    The Bail Application is allowed as above.<\/p><\/blockquote>\n<p>                                K.T.SANKARAN, JUDGE<br \/>\nvgs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.I.
