This second appeal is directed against  <\/p>\n

\nappears to have   by the trial

 borrowed a sum of Rs.3O,(}00\/—\n<\/p>\n

– 3.2 396 pa iiowards the repayment ef the said amouni, the<\/p>\n
  issued the Cheque bearing N0. 5643426 in faveur<\/p>\n
‘   plaintiff and requested the plaihtiff to eneash the<\/p>\n
  “‘eEieque a\ufb01er the imimation from him. Hewever, the<\/p>\n

\ndefendant did not intimate the plaintiff as to on what date he<\/p>\n
should present the cheque for encashment and thereafter, in<\/p>\n
spite of the repeated demands made by the “the<\/p>\n
defendant failed to repay the amount, as such,  <\/p>\n
is liable to pay the prineipa} amou::t”‘0f~  a<\/p>\n
sum of Rs. 14,450\/– towards ‘1nterest’.;__  <\/p>\n

in favour  the  repayment of the said<\/p>\n

 thereafter, the said cheque has been misused by the plain\ufb01\ufb02<\/p>\n

\nby entering his name as Payee and thereby a false claim has<\/p>\n
been made in the suit. p\n<\/p>\n
4. The trial Court on the basis of the  the
\nparties, framed the following three issues:–  it  <\/p>\n
i) Whether the plaintiff  ;5ro~:*e_s’–, that” \u00ab_  .

\nfrom him on 01.10.1992 a.I_1dl_ pa},-{V

ii) Whether the defendant “proves thatthe son 1′

  was issued. The trial Court further heid that the defendant<\/p>\n

\nhas preved that the cheque in question was delivered to the<\/p>\n
son of the plaintiff Without consideration, and therefereewthe<\/p>\n
plaintiff is not entitled fer the decree as soiight,  <\/p>\n
of the matter, the trial Court dismissed the’S1*1it:; = . <\/p>\n
by the said judgement and decree, the <\/p>\n

cheque has men mis-used by the plaintiff. In that View of<\/p>\n
the matter, the Lower Appellate Court allowed \ufb02eet<\/p>\n
aside the judgement and decree passed by V’ <\/p>\n
dismissing the suit and decreed the :’5tiit’fe1f  ‘<\/p>\n
interest at 6% p.a. on the Said sum   <\/p>\n

T  has not properiy appreciated the oral and<\/p>\n

transaction between the plainti\ufb01’ and the defenda\ufb01t<\/p>\n

8. *~ Vvtfiaving regard to the facts anti circumstances of<\/p>\n
  the evidence as referred to by the Courts below,<\/p>\n
.  V’ of the considered opinion that the Lower Appellate<\/p>\n
  court was juseeee in decreeiug the suit of the plaintiff and<\/p>\n

\nthe findings of the Lower Appellate Court are ix} accordance<\/p>\n
with the excel and documentary evidence. Hence, the said
\nfindings of the Lower Appeiiate Court does not warrant<\/p>\n
interference by this Ceiiri: in the second appeal.<\/p>\n
9. As noticed above, the defendant   <\/p>\n
issued cheque in question. His defence waeiiitfiei\u00bb t1’1e_’  A ‘<\/p>\n
cheque was delivered to. the son    <\/p>\n
mentioriing the pa}\/ee’s nameiieiiai theit.__che\u20ac1i;e”:..;hae  V L’<\/p>\n
misused by the plaintiff. leis t1f;e*–defe1\u00a7dg1ntei’fu:*th.e\u00a7r defence<\/p>\n
that there  A1120  -I tr\u00e9rimetion between him and<\/p>\n
the  : ‘_EX.\u00a7:’VS”V:.ie:me.”eefL:.i1i:er–f0i1 of the cheque. The<\/p>\n
cheque   piainti\ufb01’ and the counter– foil<\/p>\n
  (Al-a?:1tevi.\u00a73O.Ox9\u00e9.”1’d3\u00ab’8’9, en the reverse side of Ex.P5, the<\/p>\n
  his sigiature. This cheque<\/p>\n

 'i.r1r'V'f2xzzo{ir of the plaintiff for a sum of Rs.1,500\/– 0:1<\/p>\n
 ee..e\u00a7. 1990. The defendant has admitted this fact. Thus,<\/p>\n
 " '\u00a7\u00a3em Exs. P5 and P6, it is clearly eetabiiehed that the<\/p>\n

\ndefendant had monetary transaction with the plaj;n.ti\ufb01’ ever:<\/p>\n
prior to 91.10.1992, on which date he has issued the<\/p>\n
CheqL’ze~Ex.P1. It is under these CiI’C11IIiSIi\u00a3lIlC6S<\/p>\n
light of this evidence, the Lower Appellate     <\/p>\n
that the defence of the defendam” “1’hat”._    he ‘<\/p>\n
monetary transac\ufb01en between him   <\/p>\n
he accepted and the said eeurld’ <\/p>\n
with the evidence on <\/p>\n
10. The son of the l  lees  examined as<\/p>\n

cheque in cl1me’etien’–w”ae ntetttll\u00e9iesued to him an\u00e9 that it was<\/p>\n
issued” “his fathezti V’Not:hiI1g has been elicited in the cross-<\/p>\n
“exa’mi:1;atieIi_ef.2 to Show that the cheque in question<\/p>\n
 ‘ wae~de’1ivei*’e{.l’_4:e’ Without mentiening the payaee’s name.<\/p>\n
 01:1 the4″etf;\u00a7,er”i};and, the Lower Appellate Gem’: notices that<\/p>\n
  \u00e9efegldent has not placed any evidence to Show that the<\/p>\n
  ehehtiue\ufb02irx question related to the year 1989 and not 1992.. If<\/p>\n
‘V V   feelly the transaction in question related to the year 1989<\/p>\n
 with the son of the plaihti\ufb01’ as alleged by him, it was not<\/p>\n

dif\ufb01cuit for him to prove the same. However, no evideiiee is<\/p>\n
produced by the defendant in this behalf.<\/p>\n
11. Having regard to the facts and  V’0:’–.  <\/p>\n
the ease, the Lower Appellate  fey’:\n<\/p>\n
rightly held that the trial   ileai’ ii .<\/p>\n
dismissing the suit of the  _\u00bb  View of ihe
\nmatter, there is no mei’ithinA   and it does not
\ninvolve any questieri pf iaw’   question of
\nlaw. In fact,    ganted the relief<\/p>\n
to the __by j directing decree only fer<\/p>\n
Rs.3o,0o0\/i-1 with  5% p.a, from the date of the<\/p>\n
