BHATT\n<\/p>\n<p>                                   &#8212;&#8212;\n<\/p>\n<pre>For the Petitioner :                   Mr. AjitKumar\nFor the CCL        :                   Mr. Anoop Kumar Mehta\n\n                                 ------\n       Order No.02                         Dated: 8th of July, 2011.\n\n<\/pre>\n<p>                The petitioner has claimed that the respondent company is<br \/>\n       mismanaging its coal and they have succumbed to pressure of<br \/>\n       some criminals and in support of which learned counsel for the<br \/>\n       petitioner has placed on record several newspaper cuttings as well<br \/>\n       as complaints submitted by the residents of the area and copies of<br \/>\n       the two F.I.Rs. Learned counsel for the petitioner further submitted<br \/>\n       that one of the F.I.R.s lodged was got withdrawn which appears to<br \/>\n       be because of the pressure generated by the criminals and copy of<br \/>\n       the F.I.R. is placed on record at page 43 of the writ petition and<br \/>\n       application for withdrawal of the said F.I.R is placed at page 45 of<br \/>\n       the writ petition. The petitioner has also placed on record the copy<br \/>\n       of the minutes of the Board of Directors dated 7.08.2010, wherein<br \/>\n       a decision was taken for handling the coal which is questioned by<br \/>\n       the petitioner. The petitioner&#8217;s counsel also submitted that the<br \/>\n       Committee was constituted in the name of the representatives of<br \/>\n       the area but it involves criminals and has given name of one of the<br \/>\n       persons, whose name is appearing is appearing in the documents<br \/>\n       annexed with the writ petition.\n<\/p>\n<p>                We are of the considered opinion that no factual material has<br \/>\n       been placed on record what has been stated by the learned<br \/>\n       counsel for the petitioner and merely in some agitation if F.I.R. was<br \/>\n       lodged and management thought that in view of the compromise<br \/>\n       that F.I.R. be withdrawn and they have taken a decision with<br \/>\n       respect to the handling of the coal awarded to one of the<br \/>\n       contractors Mr. Deoraj , who also has consented to the decision<br \/>\n       dated 07.08.2010, Annexure-8, we do not find any cause of lodging<br \/>\n       of the F.I.R. which is in one and two days prior to allotment of<br \/>\n       award.\n<\/p>\n<p>                         We do not find any just reason to entertain this petition in the<br \/>\n                 form of P.I.L. for want of sufficient material.
