Bang], [2] Godrej Ind. Ltd. v\/s<br \/>\n\tUnion of India, 2004 [171] EL 5 [Bom], and [3] Bharat Petroleum<br \/>\n\tCorporation Ltd. v\/s Commissioner of Customs, Mumbai, 2003 [58] RLT<br \/>\n\t219 [Tri. Mum], when the facts and circumstances of these cases are<br \/>\n\tdifferent to that of the present one?\n<\/p>\n<p>(ii)\tWhether,<br \/>\n\tin the facts and circumstances of the case, the Circular issued by<br \/>\n\tthe Central Board of Excise &amp; Customs I.e. Circular<br \/>\n\tNo.96\/2002-CUS dated 27.12.2002 is not binding on the Departmental<br \/>\n\tOfficers?\n<\/p>\n<p>Heard<br \/>\n\tMs.Amee Yajnik, the learned Standing Counsel appearing for the<br \/>\n\tRevenue and perused the orders passed by the authorities below.\n<\/p>\n<p>While<br \/>\n\tdisposing of all the Appeals, the Tribunal has observed that the<br \/>\n\tlower authorities have relied upon the Board&#8217;s Circular wherein the<br \/>\n\tissue stands decided by the Tribunal judgment laying down that the<br \/>\n\tactual quantity discharged which will be leviable to duty and not<br \/>\n\tthe quantity as disclosed in alleged survey report.  The Tribunal<br \/>\n\thas also referred to the decisions of various Tribunals.  The<br \/>\n\tTribunal has further observed that the Assistant Commissioner in his<br \/>\n\torder has held that though the issue is covered by the earlier<br \/>\n\tdecision of the Tribunal, as there is subsequently a Board Circular,<br \/>\n\tthe Tribunal decision need not be followed by him.  The Tribunal was<br \/>\n\ttherefore of the view that the Tribunal decision lays down the<br \/>\n\tcorrect interpretation of law and cannot be ignored on the ground<br \/>\n\tthere is a contrary circular of the Board.  Inasmuch as the issue is<br \/>\n\tcovered by the various decisions of the Tribunal.  Thus the Tribunal<br \/>\n\thas followed its own orders instead of following the Circular of the<br \/>\n\tBoard.\n<\/p>\n<p>From<br \/>\n\tthe tenor of the questions framed by the Revenue and considering the<br \/>\n\tdiscussion made by the Tribunal in its order, we are of the view<br \/>\n\tthat no substantial question of law arises out of the order of the<br \/>\n\tTribunal.
