\nPresent petition is preferred seeking below mentioned relief\/s:-\n<\/p>\n
“(A)
\nYour Lordships may be pleased to issue writ of certiorari, mandamus
\nor any other appropriate writ, order or direction to quash and set
\naside the impugned order dated 18.4.2009 passed by the Industrial
\nTribunal, Baroda in Reference (IT) No. 125 of 2004, passing order to
\nproduce documents by the Union-annexed as Annexure-A hereto; and<\/p>\n
(B)
\nYour Lordships may be pleased to stay implementation or execution of
\nthe impugned order dated 18.4.2009 passed by the Industrial Tribunal,
\npending hearing and disposal of the petition; and<\/p>\n
(C)
\nYour Lordships may be pleased to issue ex-parte ad-interim
\ninjunction, in terms of the prayer 12(B) above; and<\/p>\n
(D)
\nYour Lordships may be pleased to pass order for expeditious disposal
\nof the matter of reference, pending for very long time (14 years), in
\ntime bound period of shortest duration; and<\/p>\n
(E)
\nYour Lordships may be pleased to pass order to initiate Contempt of
\nthe court proceedings against the Company Representatives; and <\/p>\n
(F)
\nGrant such other and further reliefs as deemed proper and pass order
\nas deemed proper in the facts and circumstances of the present case;
\nand <\/p>\n
(G)
\nCost may kindly be granted to the Union.”\n<\/p>\n

\nThe petitioner, who appears as party-in-person, has made reference to
\nthe relief prayed for in the petition and in light of that the
\nimpugned direction given by the learned Industrial Tribunal by virtue
\nof paragraph 11 in the order dated 18.4.2009 page 31 has been
\nexamined.\n<\/p>\n

\nThe petitioner is essentially aggrieved by the direction given by the
\nlearned Tribunal for production of documents as it comes out from the
\nperusal of paragraph 11 of the impugned order dated 11.4.2009. Ex
\nfacie order is interlocutory. This Court has made it clear to the
\npetitioner that the Court is not inclined to entertain the petition
\nand\/or to interfere with the order which is passed at interlocutory
\nstage and it would be open to the petitioner to take his own
\ndecision, at his risk and cost, either to comply with the order or
\nnot to comply with the order and invite consequences of not complying
\nthe direction in the order (viz. adverse inference which may be drawn
\nby the Tribunal).\n<\/p>\n
 \tAs
\nregards the relief prayed for in paragraph 12(E) it is made clear to
\nthe petitioner that appropriate proceedings e.g. proceedings under
\nthe provision of ‘Contempt of Court Act’ may be required to be taken
\nout for seeking the type of relief which is prayed for in para 12 (E)
\nhowever, it is for the petitioner to decide and select the course of
\naction and appropriate forum to seek the said relief. It is also made
\nclear to the petitioner that in present proceedings i.e. in this
\npetition (where the order dated 18.4.2009 is sought to be challenged)
\nit would not be feasible to grant relief prayed for in para 12(E)
\ni.e. of initiating Contempt of Court proceedings against company
\nrepresentatives, particularly in absence of any reference by the
\nlearned Industrial Tribunal for intimating such proceedings when no
\none has filed any application under Contempt of Court Act.\n<\/p>\n

\nAs regards the relief prayed for in paragraph 12(D) also it is made
\nclear to the petitioner that this Court may make appropriate
\nobservation for expeditious hearing and decision in the reference so
\nthat early conclusion of the proceedings can be ensured.\n<\/p>\n
5.\tSince
\nthe petitioner appears as party-in-person, this Court has also
\nsuggested that Legal Aid, by way of appointing an advocate who appear
\nand argue on behalf of the petitioner, if he desires, may be made
\navailable.\n<\/p>\n
6.\tAt
\nthis stage the petitioner has requested for time to take decision as
\nregards the option of accepting Legal Aid or any assistance of
\nadvocate and also in light of the view expressed by the Court as
\nregards prayer made in paragraph 12(D).\n<\/p>\n
7.\tThe
\nrequest is opposed by Mr. Gandhi, learned advocate for the respondent
\non the ground that during the previous hearing also the proceedings
\nwere adjourned on the same ground and for the same purpose.\n<\/p>\n

\nHowever, considering the fact that the petitioner appears as
\nparty-in-person some indulgence is justified and is granted.\n<\/p>\n

\nThe request is accepted. The hearing of the present petition is
\nadjourned to 7.3.2011.\n<\/p>\n
10.
\nAt this stage the petitioner has requested that since the proceedings
\nbefore the learned Tribunal are scheduled to take place on 11.3.2011
\nany date after the said date of hearing before the learned Tribunal
\ni.e. 11.3.2011 may be fixed for further hearing.\n<\/p>\n
11.\tConsidering
\nthe said request the hearing of the present petition is adjourned to
\n14.3.2011.\n<\/p>\n
12.
\nThe petitioner has tendered additional affidavit dated 18.2.2011
\nwhich is taken on record.\n<\/p>\n
13.
\nAt this stage the petitioner has made reference to paragraph 12(F)
\nand submitted that he has prayed for the said relief also. The said
\nparagraph 12(F) reads thus:-\n<\/p>\n
