Munir\n\nHon'ble Chandramauli Kumar Prasad,Chief Justice\nHon'ble Arun Tandon,J.\n<\/pre>\n<p>Respondent no.3-appellant, aggrieved by order dated 15.12.2009<br \/>\npassed by a learned Single Judge in Civil Misc. Writ Petition<br \/>\nNo.67045 of 2009, has preferred this special appeal under Rule 5<br \/>\nChapter VIII of the Allahabad High Court Rules.\n<\/p>\n<p>Writ petitioner-respondent no.8 filed writ application for quashing<br \/>\nthe orders dated 14.9.2009, 29.10.2009 and 12.11.2009. The order<br \/>\ndated 14.9.2009 is an order by which she was put under<br \/>\nsuspension. The orders dated 29.10.2009 and 12.11.2009 are the<br \/>\norders passed by the District Inspector of Schools, whereby order<br \/>\nof suspension of the writ petitioner was approved. The District<br \/>\nInspector of Schools, vide order dated 12.12.2009 had withdrawn<br \/>\nthe orders dated 29.10.2009 and 12.11.2009 during the pendency<br \/>\nof the writ application.\n<\/p>\n<p>In view of the aforesaid, the learned Single Judge observed that the<br \/>\nwrit petitioner cannot be treated to be under suspension for the<br \/>\ntime being, as the order of suspension cannot be said to be<br \/>\napproved by the District Inspector of Schools within stipulated<br \/>\ntime in writing within the requirement of Section 16-A (7) of the<br \/>\nIntermediate Education Act.\n<\/p>\n<p>We do not find any error in the same.\n<\/p>\n<p>However, this will not preclude the appellant to challenge the<br \/>\norder dated 12.12.2009 passed by the District Inspector of Schools,<br \/>\nwhereby he had withdrawn the orders dated 29.10.2009 and<br \/>\n12.11.2009 in an appropriate proceeding.\n<\/p>\n<p>Accordingly, the appeal stands dismissed with the observations<br \/>\naforesaid.\n<\/p>\n<p>Order Date :- 1.2.2010<br \/>\nRKK\/-\n<\/p>\n<blockquote><p>                                       (Arun Tandon, J) (C.K.
