ABDUL REHIM, J\n                -------------------------------\n              WP(C) NO. 34579 OF 2010\n              -------------------------------------\n        Dated this the 21st day of December, 2010\n\n\n                        JUDGMENT\n<\/pre>\n<p>     Consequent to default committed by the petitioner in<\/p>\n<p>repaying a housing loan availed from the respondent<\/p>\n<p>Bank, steps under the Securitisation and Reconstruction<\/p>\n<p>of Financial Assets and Enforcement of Security Interest<\/p>\n<p>Act, 2002 (SARFAESI Act) was initiated.             Immovable<\/p>\n<p>property, which is the secured asset, was proceeded<\/p>\n<p>against.  The Writ Petition was filed at a stage when<\/p>\n<p>notice under Section 13(2) issued.           According to the<\/p>\n<p>petitioner he had remitted considerable amounts and<\/p>\n<p>approached the Bank seeking time for settlement of the<\/p>\n<p>balance, but coercive steps were threatened without<\/p>\n<p>considering such requests.          Hence the petitioner is<\/p>\n<p>seeking interference of this Court.\n<\/p>\n<p>     2.   However, it is submitted that the respondent<\/p>\n<p>Bank had     already     approached       the Chief Judicial<\/p>\n<p>Magistrate Court invoking Section 14(1) and Advocate<\/p>\n<p><span class=\"hidden_text\">                              2<\/span><br \/>\nWP(C) No. 34579\/2010<\/p>\n<p>Commissioner was appointed to take over possession of the<\/p>\n<p>property. It is submitted by learned counsel appearing for<\/p>\n<p>the respondent Bank that the loan account is in chronic<\/p>\n<p>default and the arrears outstanding is around Rs.5.14 lakhs.<\/p>\n<p>     3.     Considering  the   effective  alternate   remedy<\/p>\n<p>available under the statute, I am of the opinion that it is not<\/p>\n<p>proper and justified on the part of this Court to interfere<\/p>\n<p>with the proceedings since the petitioner has not chosen to<\/p>\n<p>avail any of such remedies.      However, as a gesture of<\/p>\n<p>indulgence, this Court had stayed dispossession of the<\/p>\n<p>petitioner from the property subject to condition of the<\/p>\n<p>petitioner remitting a sum of Rs.1 lakh. It is reported that<\/p>\n<p>the stipulation has already been complied with.<\/p>\n<p>     4.     Learned counsel appearing for the petitioner<\/p>\n<p>seeks indulgence of this Court in permitting payment of the<\/p>\n<p>balance outstanding in a phased manner, on the basis of an<\/p>\n<p>undertaking that the petitioner is relinquishing all<\/p>\n<p>challenges against proceedings and that he is not intending<\/p>\n<p><span class=\"hidden_text\">                              3<\/span><br \/>\nWP(C) No. 34579\/2010<\/p>\n<p>to pursue any of the statutory remedies.          Eventhough<\/p>\n<p>interference on merits is not desirable, I am of the view that<\/p>\n<p>considering the facts and circumstances the petitioner can<\/p>\n<p>be permitted to pay off the balance outstanding in<\/p>\n<p>instalments within a reasonable time.<\/p>\n<p>     5.     Accordingly, the Writ Petition is disposed of<\/p>\n<p>directing the respondents to keep in abeyance all further<\/p>\n<p>steps of recovery, provided the petitioner remits the entire<\/p>\n<p>balance outstanding along with interest and expenses if any<\/p>\n<p>due, in 6 (six) equal monthly instalments falling due on or<\/p>\n<p>before 15.01.2011 and on or before the 15th day of the<\/p>\n<p>succeeding months.\n<\/p>\n<p>     6.     It is made clear that on the event of default in<\/p>\n<p>payment of any one of the instalments as stipulated above,<\/p>\n<p>the respondents will be free to proceed with further steps<\/p>\n<p>on the basis of the proceedings pending before the Chief<\/p>\n<p>Judicial Magistrate Court. It is also made clear that the<\/p>\n<p>relief granted above is subject to the condition that the<\/p>\n<p><span class=\"hidden_text\">                            4<\/span><br \/>\nWP(C) No. 34579\/2010<\/p>\n<p>petitioner is precluded from raising any subsequent<\/p>\n<p>challenge against the proceedings.\n<\/p>\n<\/p>\n<p>                                 C.K.
