Justice P.BHAVADASAN\n\n Dated :31\/07\/2009\n\n O R D E R\n              P.R.RAMAN &amp; P.BHAVADASAN, JJ.\n\n                   -------------------------------\n\n                    W.P.(C) No.21151 of 2009\n\n                   -------------------------------\n\n                  Dated this the 31st July, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>Raman, J.\n<\/p>\n<\/p>\n<p>             The petitioner is engaged in the business of<\/p>\n<p>construction of flats, at present at Pangappara Village. He has<\/p>\n<p>got his own permanent workmen.           At the same time, he is<\/p>\n<p>prepared to engage the required workers from the party<\/p>\n<p>respondents for loading and unloading work.         But his present<\/p>\n<p>problem is that because of the inter rivalry     union dispute, he is<\/p>\n<p>not able to do the work.\n<\/p>\n<\/p>\n<p>             2. We have issued notice and party respondents<\/p>\n<p>have entered appearance. Third respondent has produced before<\/p>\n<p>us a decision rendered by the 7th respondent, Assistant Labour<\/p>\n<p>Officer, who is the competent authority under the Act, resolving<\/p>\n<p>the dispute and certifying that third respondent&#8217;s unit is the<\/p>\n<p>authorized unit for doing the loading and unloading work in the<\/p>\n<p>W.P.(C) No.21151 of 2009<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>area in question.       If so, the members of that union having<\/p>\n<p>registration be engaged by the petitioner and no obstruction shall<\/p>\n<p>be caused by other unions in the party array.         The police will<\/p>\n<p>give necessary protection to the petitioner in case of such<\/p>\n<p>obstruction.\n<\/p>\n<\/p>\n<p>                3. However, in case, the other party respondents<\/p>\n<p>have     got a case that the said decision is taken by the 7th<\/p>\n<p>respondent without hearing them, or, if they are otherwise<\/p>\n<p>aggrieved by such decision, it is open to them to prefer an appeal<\/p>\n<p>or such other proceedings challenging the decision of the 7th<\/p>\n<p>respondent.
