VENKATASWAMI, J.\n<\/p>\n<p>     These two special leave petitions are preferred against<br \/>\nthe common  judgment and order in e.j.c. Nos. 263 and 879 of<br \/>\n1991 dated  13.9.1993 passed  by the High Court of Orissa at<br \/>\nCuttack.\n<\/p>\n<p>     The petitioners  who were\tunsuccessful before the High<br \/>\nCourt are  the employees  of  Rourkela\tSteel  Plant.  Being<br \/>\naggrieved  by  the  promotion  policy  and  rules  of  Steel<br \/>\nAuthority of  India Limited  (hereinafter referred to as the<br \/>\n&#8216;SAIL&#8217;) as  adopted in the year 1986 superseding the earlier<br \/>\npolicy holding\tthe field,  they challenged  the same before<br \/>\nthe  High  Court.  Incidentally\t they  also  challenged\t the<br \/>\npromotions made\t on the\t basis\tof  the\t impugned  promotion<br \/>\npolicy. Be it noted, it does not appear from the judgment of<br \/>\nthe High  Court that  there was\t any challenge\tof promotion<br \/>\ngiven to private opposite parties individually.\n<\/p>\n<p>     Before the\t High Court  several contentions were raised<br \/>\nchallenging the\t impugned  promotion  policy.  However,\t the<br \/>\nlearned Judges while upholding the promotion policy impugned<br \/>\nbefore them  made certain  directions in  paragraph  12\t and<br \/>\nobservations in paragraphs 15 and 19 of their judgment.\n<\/p>\n<p>     Mr. P.P.  Rao, learned Senior Counsel appearing for the<br \/>\npetitioners, in\t view of  the directions in paragraph 12 and<br \/>\nobservations made  in paragraphs 15 and 19 of the High Court<br \/>\njudgment, fairly stated before us that he is not challenging<br \/>\nthe legality  and validity of the impugned promotion policy.<br \/>\nNevertheless he\t wanted to challenge the promotions given to<br \/>\nrespondents 4  to 17  in one Special Leave Petition and 4 to<br \/>\n31 in  other\/second Special  Leave Petition. When we pointed<br \/>\nout that  no such  individual challenge\t to promotion of the<br \/>\nabove mentioned\t respondents was  made before the High Court<br \/>\nand in\tview of\t the fact  that there is no challenge to the<br \/>\npromotion policy  before us,  there is\tno  scope  for\tsuch<br \/>\ncontention, the\t learned counsel  submitted that  before the<br \/>\nHigh Court the promotions were also challenged. As we stated<br \/>\nearlier, promotions as a whole were challenged on the ground<br \/>\nthat promotion\tpolicy impugned\t before the  High Court\t was<br \/>\nillegal, arbitrary  and liable\tto be  struck down.  If that<br \/>\nbasis does  not now  survive in view of the directions given<br \/>\nby the\tHigh  Court,  there  does  not\tremain\tany  serious<br \/>\nchallenge to  individual promotions given to the respondents<br \/>\nmentioned above.\n<\/p>\n<p>     We may  also point\t out that  in view  of the fact that<br \/>\nindividual promotions  were not\t challenged, presumably\t the<br \/>\nconcerned respondents  did not\tappear before the High Court<br \/>\nas well as in this Court in spite of notice. Further we find<br \/>\nfrom the  judgment of the High Court that the learned Judges<br \/>\nhave gone  into the documents made available before them and<br \/>\nrecorded a finding as follows :-\n<\/p>\n<blockquote><p>     &#8220;From what has been stated above, we are<br \/>\n     satisfied that  the SAIL  has taken  all<br \/>\n     efforts humanly  possible to  see that a<br \/>\n     true appraisal  is made  of an executive<br \/>\n     before he\tis promoted  from the post of<br \/>\n     Assistant Manager to Deputy Manager.&#8221;<\/p><\/blockquote>\n<p>     In view  of the above finding and in the absence of any<br \/>\nother material\tto hold\t otherwise, we do not think there is<br \/>\nany cause for interference.\n<\/p>\n<p>     In the  result, the  Special Leave\t Petitions fail\t and<br \/>\nare, accordingly, dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Debaraj Padhi &amp; Others vs Steel Authority Of India Limited &amp; &#8230; on 14 September, 1995 Equivalent citations: 1995 SCC (6) 41, JT 1995 (9) 521 Author: J S Verma Bench: Verma, Jagdish Saran (J) PETITIONER: DEBARAJ PADHI &amp; OTHERS Vs.
