Jain, J. <\/p>\n<p>1. This revision petition raises a short question<br \/>\nof law:- &#8220;Is an agreement entered between the parties<br \/>\npursuant to a compromise arrived with the aid of police<br \/>\nis not a valid and enforceable agreement and cannot<br \/>\nform the basis of a summary suit under the provisions<br \/>\nof order xxxvII of the Code of Civil Procedure.?&#8221;\n<\/p>\n<p>2. The petitioner herein filed a suit under order<br \/>\nxxxvII of the Code of Civil Procedure for recovery of<br \/>\nRs. 90,424\/- against the respondent on the basis of<br \/>\nagreement dated 8th September, 1998, reached between<br \/>\nthe parties pursuant to compromises\/settlement through<br \/>\nthe cooperation of S.H.O. Police Station I.P. Estate,<br \/>\nNew Delhi. The learned Civil Judge to whom the suit<br \/>\nwas made over instead of treating the said suit as a<br \/>\nsummary suit and taking further proceedings in<br \/>\naccordance with the provisions of order xxxvII CPC, by<br \/>\nan order dated 11.5.2000 treated the said suit as an<br \/>\nordinary civil suit and directed the issue of summons<br \/>\nfor settlement of issues in the ordinary form against<br \/>\nthe defendant, holding that the agreement relied upon<br \/>\nby the plaintiff was not an agreement contemplated by<br \/>\nRule 2(b) of order xxxvII and it lacked order xxxvII<br \/>\nCPC. Aggrieved by the said order the petition had<br \/>\nearlier filed a CM (M) bearing No. 388\/00 which was<br \/>\ndismissed as withdrawn by this court on 17.7.2000,<br \/>\nhowever with liberty to the petitioner to take<br \/>\nappropriate remedy against the impugned order. The<br \/>\npetitioner has subsequently filed the present revision<br \/>\npetition.\n<\/p>\n<p>3. Notice to show cause was issued to the<br \/>\nrespondent who did not choose to appear or he<br \/>\nrepresented in the proceedings. I have heard the<br \/>\nlearned counsel for the petitioner and have given my<br \/>\nthoughtful consideration to his submissions. The<br \/>\nagreement which is the basis of the summary suit filed<br \/>\nby the petitioner is contained in a deed dated 8.9.98<br \/>\nprefaced as &#8216;compromise letter&#8217;. The relevant portion<br \/>\nthe said deed reads as under:-\n<\/p>\n<p>  &#8220;Today, the 8.9.98, we both<br \/>\nhave agreed to solve the matter by<br \/>\nmutual understanding through the<br \/>\ncooperation, S.H.O. I.P. Estate, New<br \/>\nDelhi-110002 for a sum of Rs. 28,300\/-<br \/>\nto be paid by Ajay Kohli to Mr. Kewal<br \/>\nKrishan Chadha, Proprietor, M\/s. K.C.<br \/>\n&amp; Co. as per Rs. 1,000\/- per month<br \/>\nstarting from 1.10.1998. So and so<br \/>\nforth, on first day of each month.\n<\/p>\n<p>Full payment of Rs. 28,300\/- shall be<br \/>\npaid by Mr. Ajay Kohli by monthly<br \/>\ncheques of Rs. 1,000\/-. All the<br \/>\ncheques shall be given in advance to<br \/>\nKewel Krishan Chandha, Prop. K.C. &amp; Co.<br \/>\nby Mr. Ajay Kohli and if he fails to<br \/>\nhonour the payment or defaults in<br \/>\npayment or dishonours the cheque for<br \/>\nany reason, the above understanding of<br \/>\ncompromise shall cease and Mr. Kewal<br \/>\nKrishan Chadha, Proprietor of M\/s K.C.<br \/>\n&amp; Co. shall have all the right to<br \/>\ntake the legal action against Mr.<br \/>\nAjay Kohli for full amount of<br \/>\nRs. 64,018.25 Shares shall be returned<br \/>\non payment.&#8221;\n<\/p>\n<p>4. Learned counsel for the petitioner has<br \/>\nemphatically urged that the impugned order of the<br \/>\nlearned trial court in treating the summary suit filed<br \/>\nby the petitioner as an ordinary civil suit is illegal<br \/>\nand based on wholly erroneous premises that the<br \/>\nagreement envisaged in order xxxvII CPC should be<br \/>\nvoluntarily agreement prior to the arising of dispute<br \/>\nand the admission should be prior to the intervention<br \/>\nof any form either judicial, police etc. and that any<br \/>\nagreement wherein the liability is allegedly admitted<br \/>\nafter the dispute has arisen before the police is<br \/>\noutside the preview of order xxxvII CPC. There seems<br \/>\nto be considerably force in this contention because no<br \/>\nsuch ridders as in sought to be imported exist in the<br \/>\nprovisions of order xxxvII CPC. Sub-rule (2) of Rule (1) of order xxxvII CPC provides that subject to the<br \/>\nprovisions of Sub-rule (1), the provisions of order<br \/>\nxxxvII apply to the following classes of suits,<br \/>\nnamely:-\n<\/p>\n<p>(a) suits upon bills of exchange, hundies and<br \/>\npromissory notes;\n<\/p>\n<p>(b) suits in which the plaintiff seeks only to<br \/>\nrecover a debt or liquidated demand in money payable by<br \/>\nthe defendant, with or without interest, arising,-\n<\/p>\n<p>(i) on a written contract; or<\/p>\n<p>(ii) on an enactment where the sum sought to be<br \/>\nrecovered is a fixed sum of money or in the nature of a<br \/>\ndebt other than a penalty; or<\/p>\n<p>(iii) on a guarantee when the claim against the<br \/>\nprinciple is in respect of a debt or liquidated demand only.\n<\/p>\n<p>5. It is, therefore, manifest that a suit for the<br \/>\nrecovery of debt or liquidated demand in money payable<br \/>\nby the defendant arising on a written contract can be<br \/>\nfiled and treated as a summary suit. A bare reading of<br \/>\nthe agreement contained in the deed dated 8.9.98 would<br \/>\nleave no doubt that the defendant had agreed to pay a<br \/>\nliquidated sum of money to the plaintiff. The mere<br \/>\nfact that the said agreement was arrived between the<br \/>\nparties by mutual understanding through the aid or<br \/>\ncooperation of a police officer with whom a complaint<br \/>\nhad been made by itself does not render the said<br \/>\nagreement invalid or unenforceable in law on the<br \/>\npremise that it is unvoluntary. It might be open to<br \/>\nthe defendant to take such a plea in the defense of the<br \/>\nsuit but it was not for the trial court to raise any<br \/>\nadverse presumption so as to doubt the validity of the<br \/>\nagreement merely because the same was reached between<br \/>\nthe parties pursuant to a compromise following a<br \/>\ncomplaint before the police. In the considered view of<br \/>\nthis court the basis of the summary suit is a written<br \/>\ncontract and the petitioner was within his rights to<br \/>\nmaintain a summary suit based on such an instrument.\n<\/p>\n<p>6. In view of the above discussion the revision<br \/>\npetition is allowed and the impugned order of the<br \/>\nlearned civil judge dated 11.5.2000 is hereby set<br \/>\naside.
