Justice R.BASANT\n\n Dated :16\/08\/2007\n\n O R D E R\n                           R.BASANT, J\n                 = = = = = = = = = = = = =\n                      B.A.No.4999 of 2007\n                = = = = = = = = = = = = = =\n             Dated this the 16th day of August, 2007\n\n                              ORDER\n<\/pre>\n<p>       Application for regular bail. Allegations are raised under<\/p>\n<p>the provisions of the Kerala Abkari Act.        The petitioner was<\/p>\n<p>allegedly found to be in possession of 7.45 litres of Indian Made<\/p>\n<p>Foreign Liquor on 03.08.2007. The petitioner was arrested and<\/p>\n<p>he continues in custody from that date.         The learned Public<\/p>\n<p>Prosecutor submits that there is no criminal antecedents for the<\/p>\n<p>petitioner.\n<\/p>\n<p>      2. The learned counsel for the petitioner prays, the learned<\/p>\n<p>Public Prosecutor does not oppose the said prayer on condition<\/p>\n<p>that the investigating officer is granted reasonable further time<\/p>\n<p>to complete the investigation and I am satisfied that the<\/p>\n<p>petitioner, can now be enlarged on bail subject to appropriate<\/p>\n<p>conditions.\n<\/p>\n<p>      3. In the result, this application is allowed. The petitioner<\/p>\n<p>shall be released on bail on the following terms and conditions.<\/p>\n<p>      i) The petitioner shall not be released from custody on the<\/p>\n<p>strength of this order prior to 20.08.2007.       The Investigators<\/p>\n<p><span class=\"hidden_text\">B.A.No.4999 of 2007              2<\/span><\/p>\n<p>shall in the meantime make every endeavour to complete the<\/p>\n<p>investigation.\n<\/p>\n<p>      ii)The petitioner shall execute a bond for Rs.50,000\/-<\/p>\n<p>(Rupees Fifty thousand only) with two solvent sureties each for<\/p>\n<p>the like sum to the satisfaction of the learned Magistrate;<\/p>\n<p>      iii) The petitioner shall     make himself available for<\/p>\n<p>interrogation before the Investigating Officer between 10 a.m and<\/p>\n<p>12 noon on all Mondays and Fridays for a period of two months<\/p>\n<p>and thereafter as and when directed by the Investigating Officer<\/p>\n<p>in writing to do so.\n<\/p>\n<\/p>\n<p>                                             (R.BASANT, JUDGE)<br \/>\nsj<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Surendranath vs State Of Kerala Represented By The on 16 August, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 4999 of 2007() 1.
