Justice P.N.RAVINDRAN\n\n Dated :23\/05\/2009\n\n O R D E R\n                   P.N.RAVINDRAN, J.\n      =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=\n               W.P.(C) No. 13725 of 2009\n      =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=\n         Dated this the 23rd    day of May, 2009\n\n                        JUDGMENT\n<\/pre>\n<p>      The petitioner is presently working      as  Part-time<\/p>\n<p>Casual Sweeper in the office of the fourth respondent. She<\/p>\n<p>claimed regularization in service and thereafter, moved this<\/p>\n<p>Court by filing W.P.(C) No.25886 of 2008.         By Ext.P1<\/p>\n<p>judgment delivered on 16.09.2008 this Court disposed of<\/p>\n<p>that writ petition with a direction to the Government to<\/p>\n<p>consider whether the petitioner is entitled to regularization<\/p>\n<p>on the terms of G.O.(P) No. 501\/2005\/Fin. dated 25.11.2005.<\/p>\n<p>The Government thereafter passed Ext.P2 order dated<\/p>\n<p>21.2.2009 holding that petitioner is not entitled to<\/p>\n<p>regularization for the reason that her engagement was<\/p>\n<p>through the local Kudumbasree unit.        Ext.P2 is under<\/p>\n<p>challenge in this writ petition.\n<\/p>\n<p>      2. Paragraph 13 of G.O (P) No.501\/2005\/Fin. dated<\/p>\n<p>25-11-2005 reads as follows:\n<\/p>\n<blockquote><p>                &#8220;13. Part-time contingent sweepers will<br \/>\n      be employed in new offices and also against<br \/>\n      arising vacancies in future, only in accordance<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 13725\/09          2<\/span><\/p>\n<p>      with the rules i.e., after getting the names from<br \/>\n      the      Employment     Exchange.     Under     no<br \/>\n      circumstances will any person be engaged<br \/>\n      otherwise than through Employment Exchange. If<br \/>\n      there is delay in making such postings, the<br \/>\n      vacancies can be filled up for two months only,<br \/>\n      through a contract with the local kudumbasree<br \/>\n      Society. As the sweeping work requires only 1 to<br \/>\n      2 hours of work a day, the Society shall be paid @<br \/>\n      Rs.4 per sq. mtrs. plus Rs.250 as monthly<br \/>\n      remuneration, subject to the condition that the<br \/>\n      total monthly payment shall not be less than<br \/>\n      Rs.600. It is reiterated that the payment will be<br \/>\n      made to the society and not the individual.&#8221;\n<\/p><\/blockquote>\n<p>Ext.P2 discloses that petitioner was engaged on 01.12.2005,<\/p>\n<p>after the Government order dated 25-11-2005 was issued.<\/p>\n<p>On the terms of paragraph 13 of the Government order<\/p>\n<p>dated    25-11-2005,     the    petitioner   cannot    claim<\/p>\n<p>regularization in service.   The petitioner is not a casual<\/p>\n<p>sweeper who was in service on the date on which the<\/p>\n<p>Government order dated 25.11.2005 was issued.           She<\/p>\n<p>was appointed only on 01.12.2005 through the local<\/p>\n<p>Kudumbhasree unit.         The Government order dated<\/p>\n<p>25.11.2005 does not contemplate regularization of Part-time<\/p>\n<p>Casual Sweepers appointed through local Kudumbhasree<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 13725\/09           3<\/span><\/p>\n<p>units after the Government order dated 25.11.2008 was<\/p>\n<p>issued.\n<\/p>\n<p>             Therefore, the stand taken by the Government<\/p>\n<p>cannot be faulted.
