Justice KURIAN JOSEPH\n\n Dated :10\/11\/2008\n\n O R D E R\n                             KURIAN JOSEPH, J.\n                   -----------------------------------------\n                        W.P(C) No.20540 of 2004\n                   -----------------------------------------\n             Dated this the 10th day of November, 2008\n\n                                  JUDGMENT\n<\/pre>\n<p>      Petitioner approached this court praying for a direction to the<\/p>\n<p>respondents to fix her pay based on Ext.P2 re-option. That was turned<\/p>\n<p>down as per Ext.P3 stating that the re-option exercised by the<\/p>\n<p>petitioner does not come under the purview of the government orders<\/p>\n<p>dated 5-2-1999 and 5-4-2003.              It is seen that this court in<\/p>\n<p>O.P.No.3548\/2003 and connected cases had considered the very same<\/p>\n<p>issue wherein it has been held as follows:-<\/p>\n<blockquote><p>                   &#8220;1)    In the matter of the employees right to<br \/>\n            exercise re-option, the question as to when the higher<br \/>\n            grade was sanctioned or became due whether before or<br \/>\n            after 31-5-1996 will be irrelevant. The cut off date will<br \/>\n            be of no consequence as regards the right to exercise<br \/>\n            re-option.    All re-options exercised during the period<br \/>\n            from 28-6-1997 to 27-9-1997 and the period from 5-2-<br \/>\n            1999 to 4-5-1999 will stand accepted.\n<\/p><\/blockquote>\n<blockquote><p>                   2) The monetary benefits resulting in favour of<br \/>\n            the employees on account of the exercise of the re-<br \/>\n            option will become admissible to them from the date of<br \/>\n            effect of the re-option and not from the date of actual<br \/>\n            filing of the re-option.\n<\/p><\/blockquote>\n<blockquote><p>                   Because of the two positions emerging as above<br \/>\n            objections, if any, raised by the Accountant General, the<br \/>\n            Government or the Departmental Officers regarding re-<br \/>\n            option exercised or re-option benefits due to the<br \/>\n            employees will be illegal and liable to be rejected.&#8221;\n<\/p><\/blockquote>\n<p>It has also been held that the re-option exercised in terms of the<\/p>\n<p>government order dated 5-2-1999 will have to be accepted.<\/p>\n<p>W.P(C).No. 20540 of 2004<br \/>\n<span class=\"hidden_text\">                                    -:2:-<\/span><\/p>\n<p>Therefore, this writ petition is disposed of directing the 4th respondent<\/p>\n<p>to consider afresh the case of the petitioner in the light of the<\/p>\n<p>judgment referred to above and extend the similar treatment to the<\/p>\n<p>petitioner ignoring Ext.P3 within a period of two months from the date<\/p>\n<p>of receipt of a copy of this judgment.\n<\/p>\n<\/p>\n<p>                                          (KURIAN JOSEPH, JUDGE)<\/p>\n<p>ahg.\n<\/p>\n<p>      KURIAN JOSEPH, J.\n<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;<br \/>\n W.P(C).No. 20540 of 2004\n<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;<\/p>\n<blockquote><p>           JUDGMENT<\/p>\n<p>     10th November, 2008<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.M.Mariam vs State Of Kerala on 10 November, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 20540 of 2004(T) 1.
