Justice R.BASANT\n\n Dated :06\/11\/2007\n\n O R D E R\n                                R.BASANT, J\n                         ------------------------------------\n                          B.A.No.6769 of 2007\n                        -------------------------------------\n              Dated this the 6th day of November, 2007\n\n                                     ORDER\n<\/pre>\n<p>      Application for regular bail. Petitioners are accused 1, 2 and 6.<\/p>\n<p>They face indictment in a prosecution under the provisions of the<\/p>\n<p>Explosive Substances Act.\n<\/p>\n<p>      2.     Investigation is completed. Final report has already been<\/p>\n<p>filed.   Cognizance has been taken by the learned Magistrate.<\/p>\n<p>Committal proceedings has been registered.                    Consequent to non<\/p>\n<p>appearance of the petitioners, the case against them has been<\/p>\n<p>transferred to the list of Long Pending Cases. Coercive processes have<\/p>\n<p>been issued by the learned Magistrate.                       The petitioners had<\/p>\n<p>surrendered before the learned Magistrate on 23.10.07.                      Their<\/p>\n<p>application for bail was rejected by the learned Magistrate.                 The<\/p>\n<p>petitioners continue in custody from that date.<\/p>\n<p>      2.     The learned counsel for the petitioners submits that the<\/p>\n<p>petitioners are absolutely innocent.              The petitioners may now be<\/p>\n<p>enlarged on bail. They may not be compelled to remain in custody<\/p>\n<p>until trial against them is completed, submits the learned counsel for<\/p>\n<p>the petitioners.\n<\/p>\n<p><span class=\"hidden_text\">B.A.No.6769 of 2007                  2<\/span><\/p>\n<p>      3.    The learned Public Prosecutor         does not oppose the<\/p>\n<p>application. The learned Public Prosecutor submits that appropriate<\/p>\n<p>conditions may be imposed to ensure that the petitioners shall be<\/p>\n<p>available for trial.\n<\/p>\n<p>      4.    Having considered all the relevant inputs, I am satisfied<\/p>\n<p>that the petitioners can be released on bail subject to appropriate<\/p>\n<p>terms and conditions.\n<\/p>\n<p>      5.    In the result, this application is allowed.
