It is averred in the writ petition that this PIL is \ufb01led\n\nfor the purpose of protecting the interests of Mavneelnand\n\nKagakl Maneer Villages of Kumta Taluk and  \n\nBiodiversity and Ecology of Western Ghats in, \n\nquestion is located in the Western  l'Responde11tllNAo.S:\n\nhas passed an order divertinglllvtveo' h_eCtaresl:of in forest\nSy.No.108\/A on the  respondent No.1<\/pre>\n
culminating the \ufb01nal seVlec’tion:loi  patently illegal
\nand they arel”:in’V  =  various statutory
\nprovisionslandl’_l’i”~%ulels  “proposal is sought to be
\nimp1e;rnented.:v5\u00bbv_V 15:71 to the interest of the
\nresidevntsl of  land in Sy.No.108\/A is the<\/p>\n
forest landlwhichprneasures approximately 800 acres and the<\/p>\n
  land is a pro’tected reserved forest land and the said<\/p>\n
  is\u00bb;looateVd–..in Manaki village which compiises of Kagal<\/p>\n
Maneer.  Maneer and other areas. The villagers<\/p>\n
 complairxed to the Deputy Conservator of Forests and<\/p>\n
 Alpulrsuant to the said complaint the forest of\ufb01cials stopped<\/p>\n
respondent No.10 from dumping any such waste and also<\/p>\n
\\,;?\n<\/p>\n
residing in the surrounding areas, representations were also<\/p>\n
given to the Regional Commissioner, Belgaurriljliliilxfision<\/p>\n
stating that there are nearly 600 to 700 hotisesenearl  <\/p>\n
land which is also called Murur C.-zudda and that’ld_11ring\u00bbthe<\/p>\n
rainy season, the rain water would ‘even enter the” <\/p>\n
which are in the lower level  the land.,,,AlHowe\\}e1*” to the”<\/p>\n
shock and surprise of the petitioners, a ‘noti\ufb01cation was<\/p>\n
published by respondentv:Iilo.llvl0llbidated 1.1.2008 in
\n‘Karavali Muiijaij\ufb01-l’a.  calling for
\ntenders     plant. In the said
\nnotifieation  where the actual MSW
\nplant llwouldl  was not published and<\/p>\n
therefore, l4lbeing_agg’neVed by the establishment of MSW<\/p>\n
    the fores’t’***area, the present writ petition is \ufb01led<\/p>\n

\nNo.10 can    after obtaining<\/p>\n
necessaryil  Pollution Control Board and<\/p>\n

\npetitioners in the .ii\u00e9anng that would be held by the<\/p>\n

  of MSW plant in the said land also would<\/p>\n
