No.34109 of 2011\n                             Nirmal Kumar\n                                 Versus\n                           The State Of Bihar\n                                -----------\n<\/pre>\n<p>02.   13.10.2011               Petitioner is apprehending his arrest in a case<\/p>\n<p>                   registered under Sections 341, 323, 379, 504, 506\/34 of<\/p>\n<p>                   the I.P.C. and Section 3 (i)(x) of the S.C. &amp; S.T.(Prevention<\/p>\n<p>                   of Atrocities) Act.\n<\/p>\n<p>                               It is alleged by the informant being Panchayat<\/p>\n<p>                   Secretary, while distributing coupons, was protested by<\/p>\n<p>                   petitioner and others as to why the name of the wife of<\/p>\n<p>                   the petitioner was not included in the beneficiaries list<\/p>\n<p>                   and demanded coupons. On protest the accused persons<\/p>\n<p>                   assaulted the informant by fists and slaps.       It is also<\/p>\n<p>                   alleged that Arvind Yadav and Krishna Kumar assaulted<\/p>\n<p>                   with fists and slaps and took away certain coupons, keys<\/p>\n<p>                   and other things.\n<\/p>\n<p>                               It is submitted by learned counsel for the<\/p>\n<p>                   petitioner that the specific accusation of assault and<\/p>\n<p>                   abuse is not against the petitioner but against 30 to 40<\/p>\n<p>                   people. Moreover due to political rivalry the petitioner has<\/p>\n<p>                   been roped since the wife of the petitioner has succeeded<\/p>\n<p>                   in the Panchayat election. It is further submitted that<\/p>\n<p>                   petitioner has no criminal antecedent.<\/p>\n<p>                               Considering   the   fact   that   accusation   is<br \/>\n           against 30 to 40 people and specific accusation of assault<\/p>\n<p>          is against two other persons, let the petitioner namely<\/p>\n<p>          Nirmal Kumar, in the event of his arrest or surrender<\/p>\n<p>          before the Court below within a period of 12 weeks from<\/p>\n<p>          today, be released on anticipatory bail on furnishing bail<\/p>\n<p>          bond of Rs. 10,000\/-(ten thousand) with two sureties of<\/p>\n<p>          the like amount each to the satisfaction of Chief Judicial<\/p>\n<p>          Magistrate, Madhepura in connection with Madhepura<\/p>\n<p>          Bharrahi P.S.Case No. 264 of 2011.\n<\/p>\n<\/p>\n<p>                                    (Dinesh Kumar Singh, J)<br \/>\nShageer\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Nirmal Kumar vs The State Of Bihar on 13 October, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
