In\t a case arising out of FIR No. 735 dated  8-11-1993,<br \/>\nrelating to the alleged dowry death of Smt Sunita  wife\t of<br \/>\nAnil  Kumar, the learned Additional Sessions  Judge,  Rohtak<br \/>\ngranted anticipatory bail to the parents and the brother  of<br \/>\nthe  husband  of the deceased Smt Sunita and  directed\tthat<br \/>\nthey  be released on bail on their furnishing bail bonds  in<br \/>\nthe  sum of Rs 10,000 each with one surety each of the\tlike<br \/>\namount\tin the event of their arrest to the satisfaction  of<br \/>\nthe Arresting Officer.\tNo bail has however been granted  to<br \/>\nthe  husband  Anil Kumar.  The State of\t Haryana  filed\t a<br \/>\npetition  in  the High Court of Punjab and  Haryana  seeking<br \/>\ncancellation  of  the  anticipatory  bail,  granted  to\t the<br \/>\nappellants  by\tthe  Additional Sessions  Judge,  Rohtak  on<br \/>\n12-11-1993.   The learned Single Judge of the High Court  by<br \/>\nhis order dated 8-9-1994, cancelled the bail observing:\n<\/p>\n<blockquote><p>\t      &#8220;Dowry death is a serious matter and cannot be<br \/>\n\t      taken  so\t lightly.  No positive\tfinding\t has<br \/>\n\t      been recorded by the Additional Sessions Judge<br \/>\n\t      in   his\t order\tto  the\t effect\t  that\t the<br \/>\n\t      respondents  and\tthe  deceased  were   living<br \/>\n\t      separately.   No prima facie case is made\t out<br \/>\n\t      which could justify the grant of\tanticipatory<br \/>\n\t      bail.   To my view of thinking, concession  of<br \/>\n\t      anticipatory  bail granted by  the  Additional<br \/>\n\t      Sessions Judge, was totally uncalled for.\t The<br \/>\n\t      order  dated  12-11-1993\tis,  therefore,\t set<br \/>\n\t      aside  and the respondents are directed to  be<br \/>\n\t      taken into custody.&#8221;\n<\/p><\/blockquote>\n<p>The  appellants\t are aggrieved of the  cancellation  of\t the<br \/>\nanticipatory bail, granted to them.  Hence this appeal.\n<\/p>\n<p>3.   It\t appears to us that whereas the\t learned  Additional<br \/>\nSessions  Judge was not justified in observing in  the\tlast<br \/>\nparagraph of his order while granting anticipatory bail\t &#8220;it<br \/>\nappears\t that  possibly these accused-appellants  have\tbeen<br \/>\nroped in falsely&#8221;, at that initial stage, when possibly\t the<br \/>\ninvestigation was not even completed let alone, any evidence<br \/>\nhad been led at the trial, the High Court also fell in error<br \/>\nin   cancelling\t the  anticipatory  bail  granted   to\t the<br \/>\nappellants for the reasons, which have been extracted by  us<br \/>\nabove.\t The learned Additional Sessions Judge\thad  noticed<br \/>\nthat  even  according  to  the statement  in  the  FIR,\t the<br \/>\nappellants were living separately from the deceased and\t her<br \/>\nhusband\t and that the factum of separate residence was\talso<br \/>\nsupported  by  the ration card.\t These\tconsiderations\twere<br \/>\nrelevant considerations for dealing with an application\t for<br \/>\ngrant of anticipatory bail.\n<\/p>\n<p>4.   Rejection of bail in a non-bailable case at the initial<br \/>\nstage  and the cancellation of bail so granted, have  to  be<br \/>\nconsidered  and dealt with on different basis.\tVery  cogent<br \/>\nand  overwhelming circumstances are necessary for  an  order<br \/>\ndirecting  the\tcancellation of the bail,  already  granted.<br \/>\nGenerally  speaking, the grounds for cancellation  of  bail,<br \/>\nbroadly (illustrative and not exhaustive) are:\tinterference<br \/>\nor   attempt   to   interfere  with  the   due\t course\t  of<br \/>\nadministration of Justice or evasion or attempt to evade the<br \/>\ndue course of justice or abuse of the concession granted  to<br \/>\nthe  accused in any manner.  The satisfaction of the  court,<br \/>\non the basis of material placed on the record of the<br \/>\n<span class=\"hidden_text\">351<\/span><br \/>\npossibility of the accused absconding is yet another  reason<br \/>\njustifying  the\t cancellation of bail.\tHowever,  bail\tonce<br \/>\ngranted\t should\t not  be cancelled in  a  mechanical  manner<br \/>\nwithout\t considering whether any  supervening  circumstances<br \/>\nhave  rendered\tit no longer conducive to a  fair  trial  to<br \/>\nallow  the  accused to retain his freedom  by  enjoying\t the<br \/>\nconcession  of bail during the trial.  These principles,  it<br \/>\nappears,  were\tlost  sight of by the  High  Court  when  it<br \/>\ndecided to cancel the bail, already granted.  The High Court<br \/>\nit  appears to us overlooked the distinction of the  factors<br \/>\nrelevant  for  rejecting bail in a nonbailable case  in\t the<br \/>\nfirst instance and the cancellation of bail already granted.\n<\/p>\n<p>5.   We\t are, therefore, satisfied that the cancellation  of<br \/>\nanticipatory bail granted to the appellants, for the reasons<br \/>\ngiven  by  the High Court, was not justified.\tNothing\t has<br \/>\nbeen  brought to our notice either from which any  inference<br \/>\nmay  possibly  be  drawn that the  appellants  have  in\t any<br \/>\nmanner, whatsoever, abused the concession of bail during the<br \/>\nintervening period.\n<\/p>\n<p>6.
