Though served, none<br \/>\nis present for the respondent.\n<\/p>\n<p>\tIn<br \/>\nthis matter, on earlier occasion, on 27.11.2009, this Court (Coram:<br \/>\nSmt. Abhilasha Kumari, J.) passed the following order:-\n<\/p>\n<p> The<br \/>\nendorsement on the board indicates that, though, notice has been<br \/>\nserved upon the Respondent, none appears on his behalf. One more<br \/>\nopportunity may be given to the Respondent to make arrangements, to<br \/>\ndefend the appeal.\n<\/p>\n<p>\tList<br \/>\non 17th December, 2009.\n<\/p>\n<p>\tThus,<br \/>\nit was ordered to be listed on 17.12.2009.\n<\/p>\n<p>Today,<br \/>\nwhen the matter is called out, none is present for the respondent.\n<\/p>\n<p>\tLooking<br \/>\nto the findings arrived at by the Courts below and the reasoning<br \/>\nadopted, this Appeal deserves consideration as it raises following<br \/>\nsubstantial question of law :-\n<\/p>\n<p>Whether<br \/>\n\tperson can be permitted to claim all advantages and rights as a<br \/>\n\tlicensee when there is no valid licence agreement ever executed<br \/>\n\tgranting him licence in respect of the stall?\n<\/p>\n<p>Can<br \/>\n\tthe person stranger to transaction be permitted to enjoy the rights<br \/>\n\tof licensee in absence of any other documentary evidence to prove<br \/>\n\tthat he entitles for the said benefits?\n<\/p>\n<p>Can<br \/>\n\ta stranger to the licensee be permitted to run the business without<br \/>\n\tlicense?\n<\/p>\n<p>Would<br \/>\n\tthe payment of license fees on behalf of licensee itself be<br \/>\n\tsufficient to permit the payer of the fees to enjoy the rights of<br \/>\n\tlicensee?\n<\/p>\n<p>\tAppeal<br \/>\nAdmitted.\n<\/p>\n<p> Order<br \/>\nin Civil Application No. : 5970 of 2008:-\n<\/p>\n<p>\tBy<br \/>\nway of interim relief, the order impugned shall remain stayed till<br \/>\nfinal disposal of the Second Appeal.\n<\/p>\n<p>(S.R.BRAHMBHATT,<br \/>\nJ.)<\/p>\n<p>pallav<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Union vs Sureshchandra on 25 January, 2010 Bench: S.R.Brahmbhatt SA\/99\/2008 2\/ 2 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD SECOND APPEAL No. 99 of 2008 With CIVIL APPLICATION No. 5970 of 2008 In SECOND APPEAL No. 99 of 2008 ========================================================= UNION OF INDIA &amp;
