V. Rajendran, the learned counsel appearing for the<\/p>\n<p>petitioner and Sri. K.S. Anil, the learned standing counsel appearing for the<\/p>\n<p>respondents.\n<\/p>\n<p>        2. The petitioner is a Sub Engineer working in the Kerala State<\/p>\n<p>Electricity Board. He entered service on 1-1-2004 and was initially posted<\/p>\n<p>in Kannur district. Thereafter, in the year 2006 he was transferred and<\/p>\n<p>posted in Ernakulam district. On transfer to Ernakulam district, he was<\/p>\n<p>posted in Electrical Section, Thoppumpady under Mattancherry Division.<\/p>\n<p>Later, by Ext.P3 order, he was transferred to           Electrical Division,<\/p>\n<p>Tripunithura at his request. The petitioner&#8217;s grievance is that though one<\/p>\n<p>year has passed after Ext.P3 order was issued, it has not so far been<\/p>\n<p>implemented.\n<\/p>\n<p>        3. The learned standing counsel for the respondents submits that the<\/p>\n<p>petitioner could not be relieved from Electrical Section, Thoppumpady for<\/p>\n<p>want of a substitute. Ext. P3 order has not been varied or modified.<\/p>\n<p>Therefore, the respondents are bound to give a posting to the petitioner in<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 16812\/09 V                 2<\/span><\/p>\n<p>Electrical Division, Tripunithura. Ext.P3 order was passed on 30-5-2008<\/p>\n<p>and more than one year has passed thereafter. In these circumstances, the<\/p>\n<p>Kerala State Electricity Board cannot contend that the petitioner could not<\/p>\n<p>be relieved for want of a substitute. It is for the Kerala Electricity Board to<\/p>\n<p>find a substitute to be posted in Electrical Section, Thoppumpady.<\/p>\n<p>        I accordingly, dispose of this writ petition with a direction to the<\/p>\n<p>competent authority among the respondents to give effect to Ext.P3 by<\/p>\n<p>posting the petitioner     in Electrical Division, Tripunithura within two<\/p>\n<p>months from today.\n<\/p>\n<\/p>\n<p>                                              P.N.RAVINDRAN,<br \/>\n                                              JUDGE.\n<\/p>\n<p>mn.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court A.S.
