Criminal Appeal No.1296 of 2007 has been partly allowed by<br \/>\n\tour separate judgement, wherein the evidence, which came on record<br \/>\n\thas been elaborately considered. We have also considered that the<br \/>\n\trecord of Sessions Case No.90 of 2002.  In view of the reasons<br \/>\n\trecorded by us in the judgement of Criminal Appeal No.1296 of 2007,<br \/>\n\tcoupled with the important aspects that the original complainant<br \/>\n\therein together with the other persons had gone to the place of<br \/>\n\tNimuben Gobarbhai and there was active attempt to kidnap her by<br \/>\n\tdragging her into the street and further role played by them in<br \/>\n\tcommission of the said offence with the circumstance of giving fatal<br \/>\n\tblow to Rajabhai Bhikhabhai Bharwad, by the complainant herein, who<br \/>\n\tultimately succumbed to the injuries, goes to show that it is at the<br \/>\n\ttime when the complainant and other persons committed the offence,<br \/>\n\twhich is the subject matter of Criminal Appeal No.1296 of 2007, the<br \/>\n\tvillagers and other people intervened and they have sustained<br \/>\n\tinjuries.  But such injuries appear to have been caused to protect<br \/>\n\tthe victim and to prevent the complainant and other persons from<br \/>\n\tfurther committing offence of kidnapping of the victim.  It is on<br \/>\n\taccount of the intervention by the other persons and the villagers,<br \/>\n\tsuch attempt to kidnap was resisted and at that stage the injuries<br \/>\n\twere received by the complainant and other persons, who are accused<br \/>\n\tin Criminal Appeal No.1296 of 2007.  If any other persons, including<br \/>\n\tthe villagers have resisted and protected the victim Nimuben coupled<br \/>\n\twith the circumstances of no satisfactory evidences led for<br \/>\n\tcommission of evidence, it appears to us that the learned Sessions<br \/>\n\tJudge has not committed any error in acquitting the accused for the<br \/>\n\toffence of Sessions Case No.90 of 2002.  If the aforesaid aspect is<br \/>\n\tconsidered, keeping in view all the evidences, which came on record<br \/>\n\tagainst the complainant herein, who are accused in Criminal Appeal<br \/>\n\tNo.1296 of 2007, it appears to us that it would not be a case for<br \/>\n\ttaking a different view than the view taken by the learned Sessions<br \/>\n\tJudge.  Even if this views are possible, acquittal cannot be<br \/>\n\tconverted into conviction.   It also appears to us that the revision<br \/>\n\tis only by way of counter blast to resist the conviction made to the<br \/>\n\taccused in Sessions Case No.36\/2001.\n<\/p>\n<p>Hence,<br \/>\n\tthe revision being meritless is dismissed.<\/p>\n<pre>\n\n \n\n \n\n\n \n\n\n\t\t\t\t\t\t\n (Jayant Patel, J.)\n \n\n\n \n\n\n \n\n\n3.3.2010\t\t\t\t\t(Rajesh\nH.
