SHAH\n\t\t\n\t\n\n \n\nDate\n: 23\/08\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tThe<br \/>\npresent application under Section 482 of the Code<br \/>\nof Criminal Procedure has been preferred by the applicant<br \/>\nherein &#8211; original accused &#8211; Ms.Ruchita H. Doshi to quash<br \/>\nand set aside the impugned complaint\/FIR being C.R.No.I-122 of 2011<br \/>\nregistered with Navrangpura Police Station, Ahmedabad against the<br \/>\napplicant for the offence punishable under Section 408 of the Indian<br \/>\nPenal Code.\n<\/p>\n<p>2.\t\tToday<br \/>\nwhen the present application is taken up for hearing, Mr.Apurva Dave,<br \/>\nlearned advocate appearing on behalf of the applicant &#8211;<br \/>\noriginal accused has stated at the bar that subsequently the dispute<br \/>\nis already amicably settled between the applicant and the original<br \/>\ncomplainant and that  total a sum of Rs.18 Lacs is already paid by<br \/>\nthe applicant pursuant to the Memorandum of Understanding entered<br \/>\ninto between the Bharat Hotels Ltd. &#8211; original complainant and the<br \/>\napplicant &#8211; Ms.Ruchita Doshi.\n<\/p>\n<p>3.\t\tMr.A.Y.Kogje,<br \/>\nlearned advocate appearing on behalf of respondent No.3 &#8211;<br \/>\noriginal complainant has produced on record xerox copy of the<br \/>\nMemorandum of Understanding entered into between Bharat Hotels<br \/>\nLimited (original complainant) and the applicant herein, which is<br \/>\ndirected to be taken on record. He has also confirmed payment of<br \/>\nRs.18 Lacs paid to the original complainant &#8211; Bharat Hotels Limited<br \/>\nby the applicant. Therefore, he has submitted that he has no<br \/>\nobjection, if the impugned complaint\/FIR is quashed and set aside.<br \/>\nHowever, he has requested to delete allegations made against the<br \/>\nCompany and its Officers in Para Nos.6 to 9 of the present petition.<br \/>\nMr.Apurva Dave, learned advocate appearing on behalf of the<br \/>\napplicant, under the instructions from the applicant, has stated that<br \/>\nas the dispute is amicably settled between the parties whatever<br \/>\nallegations are made against the Company and\/or its Officers in the<br \/>\npresent petition more particularly in Para Nos.6 to 9 to the<br \/>\npetition, the applicant withdraw the same.\n<\/p>\n<p>\t\tMr.Apurva<br \/>\nDave, learned advocate appearing on behalf of the applicant has also<br \/>\nrequested that election card of the applicant is lying with the<br \/>\noriginal complainant, which may be returned to the applicant.<br \/>\nMr.A.Y.Kogje, learned advocate appearing on behalf of respondent No.3\n<\/p>\n<p>&#8211; original complainant has stated that if the election card of<br \/>\nthe applicant is with the original complainant, the same shall be<br \/>\nreturned to the applicant.\n<\/p>\n<p>4.\t\tLearned<br \/>\nadvocates appearing on behalf of the respective parties have relied<br \/>\nupon the decision of the Hon&#8217;ble Supreme Court in the case of Madan<br \/>\nMohan Abbot V\/s. State of Punjab reported in 2008(4) SCC 582;<br \/>\nin the case of  Nikhil Merchant V\/s. Central Bureau of<br \/>\nInvestigation and another reported in 2009(1) GLH 31 as<br \/>\nwell as in the case of Manoj Sharma V\/s. State and others reported<br \/>\nin 2009(1) GLH 190.\n<\/p>\n<p>5.\t\tHaving<br \/>\nheard learned advocates appearing on behalf of the respective parties<br \/>\nand considering the fact that the dispute between the original<br \/>\ncomplainant and the applicant has been amicably settled now and the<br \/>\ndispute prima facie seems to be private in nature and in view of the<br \/>\nMemorandum of Understanding entered into between the original<br \/>\ncomplainant and the applicant and entire amount i.e. Rs.18 Lacs has<br \/>\nalready been paid by the applicant and considering the aforesaid<br \/>\ndecisions of the Hon&#8217;ble Supreme<br \/>\nCourt, it appears to the Court that to continue proceedings<br \/>\nagainst the applicant would be unnecessary harassment to the parties<br \/>\nas now the original  complainant is not likely to proceed further<br \/>\nwith the case in view of the above settlement, this Court is of the<br \/>\nopinion that this is a fit case to exercise power under Section 482<br \/>\nof the Code of Criminal Procedure and to quash and set aside the<br \/>\nimpugned complaint\/FIR so far as the present applicant is concerned.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the above and for the reasons stated hereinabove, the<br \/>\npetition succeeds.
