LTD. - Appellant(s)\n \n\nVersus\n \n\nPARESH\nVASANTBHAI SOLANKI &amp; 1 - Defendant(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nPV NANAVATI for\nAppellant(s) : 1,MR VIBHUTI NANAVATI for Appellant(s) : 1, \nNone\nfor Defendant(s) : 1 -\n2. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE JAYANT PATEL\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/09\/2007 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tpresent appeal is against the award passed by the Tribunal for<br \/>\n\tpaying interim compensation.\n<\/p>\n<p>Upon<br \/>\n\thearing Mr.Nanavati, learned Counsel for the appellant, it appears<br \/>\n\tthat the matter is covered by the decision of this Court in First<br \/>\n\tAppeal No.1768 with No.1769 of 2007 dated 30.3.2007 and this Court<br \/>\n\tin the said decision observed as under:-\n<\/p>\n<p>?S3.\t\tMr.\n<\/p>\n<p>\t\t\tNanavati, learned counsel appearing for the appellants in both the<br \/>\n\t\t\tappeals raised the contention that since there was no additional<br \/>\n\t\t\tpayment of the premium, qua liability of the driver, there was no<br \/>\n\t\t\tliability of the insurance company and consequently, the Tribunal<br \/>\n\t\t\thas no jurisdiction. Therefore, he submitted that the Appeals may<br \/>\n\t\t\tbe entertained. During the course of the hearing, he relied upon<br \/>\n\t\t\tthe decision of this Court in First Appeal No.1193\/02<br \/>\n\t\t\t(Coram:A.M.Kapadia,J.) decided on 31.03.2005; in First Appeal<br \/>\n\t\t\tNo.3088\/97 &amp; Ors. (Coram:K.S.Jhaveri,J.) decided on<br \/>\n\t\t\t14.08.2006; in First Appeal No.2310\/03 (Coram:Akshay H.Mehta,J.)<br \/>\n\t\t\tdecided on 21.02.2007 and he contended that different views are<br \/>\n\t\t\ttaken. However, considering the facts and circumstances, similar<br \/>\n\t\t\tview may be taken by this Court.\n<\/p>\n<p>4.\tIt<br \/>\n\t\t\tmay be recorded that essential purpose of fixing the payment under<br \/>\n\t\t\tSection 140 of the Motor Vehicles Act is to provide immediate<br \/>\n\t\t\tcompensation by way of an interim measure to the injured or the<br \/>\n\t\t\tvictim of the accident or the dependents, as the case may be. The<br \/>\n\t\t\tdetailed examination of the contention may be at the time when<br \/>\n\t\t\tfinal award is passed and such an interim order is subject to the<br \/>\n\t\t\tfinal award. It may be that in very very rare case, this Court may<br \/>\n\t\t\texamine the question of jurisdiction, if it touches to the root of<br \/>\n\t\t\tthe matter. However, normally the defence of the Insurance Company<br \/>\n\t\t\tcan better be examined at the final award. If such an approach is<br \/>\n\t\t\tnot taken and the exercise of power under Section 140 is read to<br \/>\n\t\t\tleave room for a full fledge detailed inquiry, it may frustrate<br \/>\n\t\t\tthe very purpose of the interim measure to be provided to the<br \/>\n\t\t\tclaimant. Suffice it to say that the Tribunal has to exercise the<br \/>\n\t\t\tjudicial discretion at the prima facie stage after considering the<br \/>\n\t\t\tmaterial prima facie. As such, the exercise is undertaken by the<br \/>\n\t\t\tconcerned Tribunal in the impugned orders, hence, I find that the<br \/>\n\t\t\tpresent cases are not such, which may fall in the exceptional<br \/>\n\t\t\tcategory for interference qua ordering for interim payment by way<br \/>\n\t\t\tof an interim measure.\n<\/p>\n<p>5.\tHowever,<br \/>\n\t\t\tthe grievance on the part of the Insurance Company against the<br \/>\n\t\t\tclaimant for refund of the amount in the event it succeeds in the<br \/>\n\t\t\tclaim petition, consequently resulting into a situation of no<br \/>\n\t\t\tliability on the part of the Insurance Company, can be<br \/>\n\t\t\tsufficiently taken care of if the claimant at the time of<br \/>\n\t\t\twithdrawal of the amount furnishes the security or surety to the<br \/>\n\t\t\tsatisfaction of the Tribunal and even otherwise also, the payment<br \/>\n\t\t\tis subject to the final award. Even on the aspects of abandonment<br \/>\n\t\t\tof the claim by the claimant after having withdrawn the amount or<br \/>\n\t\t\tafter having received the interim payment, may not be permissible<br \/>\n\t\t\tand therefore, the grievance raised on behalf of the appellants to<br \/>\n\t\t\tthe extent of putting condition upon the claimant to file an<br \/>\n\t\t\tundertaking appears to be reasonable.\n<\/p>\n<p>6.\tIt<br \/>\n\t\t\tappears that the above referred decisions of different Benches of<br \/>\n\t\t\tthis Court, in certain cases, withdrawal of the payment is<br \/>\n\t\t\tpermitted to the extent of 50%, whereas in certain case, the<br \/>\n\t\t\tamount is ordered to be deposited in the Fixed Deposit Receipt and<br \/>\n\t\t\tthe interest is made payable. In the impugned orders, the Tribunal<br \/>\n\t\t\thas permitted withdrawal to the extent of 30%, so far as First<br \/>\n\t\t\tAppeal No. 1768\/07 is concerned and so far as First Appeal No.<br \/>\n\t\t\t1769\/07 is concerned, the Tribunal has permitted 50% of withdrawal<br \/>\n\t\t\tand the remaining amount in both the cases are even otherwise<br \/>\n\t\t\tordered to be invested to the Tribunal.\n<\/p>\n<p>7.\tUnder<br \/>\n\t\t\tthe above circumstances, I find that if the withdrawal as ordered<br \/>\n\t\t\tby the Tribunal is permitted on furnishing of solvent<br \/>\n\t\t\tsurety\/security to the satisfaction of the Tribunal, the same<br \/>\n\t\t\twould not prejudice the rights of the claimant. Similarly, if the<br \/>\n\t\t\tundertaking is ordered to be filed by the claimant as per the<br \/>\n\t\t\tdecision, the same also would not be prejudicial to the rights of<br \/>\n\t\t\tthe claimants since in any case, the claimant is to proceed with<br \/>\n\t\t\tthe claim petition for further compensation.??\n<\/p>\n<p>Similar<br \/>\n\tdirections and observations to be issued in the present appeal also.<br \/>\n\t Hence, the following directions:-\n<\/p>\n<p>(a)\t\tThe<br \/>\n\timpugned order of the Tribunals are not required to be interfered<br \/>\n\twith at this stage. However, the order of the Tribunal shall<br \/>\n\tcontinue with the further following directions:\n<\/p>\n<p>(i)\t\tThe<br \/>\n\t\t\tTribunals shall permit withdrawal of the amount upon the<br \/>\n\t\t\tfurnishing of solvent surety\/security of the equal amount by the<br \/>\n\t\t\tclaimants.\n<\/p>\n<p>(ii)\t\tThe<br \/>\n\t\t\tclaimants shall also file an undertaking before the Tribunal prior<br \/>\n\t\t\tto the withdrawal of the order to the effect that the main claim<br \/>\n\t\t\tpetition shall not be abandoned or shall not be withdrawn or shall<br \/>\n\t\t\tnot be permitted to be dismissed in default or for any other cause<br \/>\n\t\t\tby him and the claimants shall pursue the main claim petition on<br \/>\n\t\t\tmerits.\n<\/p>\n<p>In<br \/>\n\tthe above circumstances, subject to the aforesaid observations and<br \/>\n\tdirections, the appeal is dismissed.  Liberty to the claimants to<br \/>\n\tapply if aggrieved by the observations and directions but before<br \/>\n\tactual withdrawal.
