Justice M.SASIDHARAN NAMBIAR\n\n Dated :25\/11\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n          ===========================\n          W.P.(C).No.35358    OF 2010\n          ===========================\n\n   Dated this the 25th day of November,2010\n\n                   JUDGMENT\n<\/pre>\n<p>    Petitioner purchased Maruthi Alto Car KL-<\/p>\n<p>54-592 in an auction conducted pursuant to an<\/p>\n<p>order of confiscation under section 67B of<\/p>\n<p>Abkari Act.    This petition is filed for a<\/p>\n<p>direction to the third respondent not to seize<\/p>\n<p>the vehicle in Crime 1298\/2007 of Kunnamkulam<\/p>\n<p>Police Station.\n<\/p>\n<p>    2.    Learned  counsel  appearing  for  the<\/p>\n<p>petitioner was heard.\n<\/p>\n<p>    3.   The argument of the learned counsel<\/p>\n<p>appearing for the petitioner is that he had<\/p>\n<p>purchased  the  vehicle  for  Rs.1,62,000\/-  on<\/p>\n<p>29.4.2009,  after  it  was   confiscated  under<\/p>\n<p>section 67B of Kerala Abkari Act in the auction<\/p>\n<p>conducted by the Joint Excise Commissioner,<\/p>\n<p>South Zone and thus he became the absolute<\/p>\n<p><span class=\"hidden_text\">W.P.(C)35358\/2010           2<\/span><\/p>\n<p>owner of the property free from any encumbrance and<\/p>\n<p>therefore third respondent has no right to proceed<\/p>\n<p>against the said vehicle.\n<\/p>\n<p>     4.    The vehicle is sought to be seized in Crime<\/p>\n<p>1298\/2007 of Kunnamkulam Police Station on the<\/p>\n<p>allegation that it is a stolen vehicle.     Petitioner<\/p>\n<p>is not entitled to contend that the police cannot<\/p>\n<p>seize the vehicle, if it is a stolen vehicle.      The<\/p>\n<p>theft was committed earlier to 2007.        Petitioner<\/p>\n<p>purchased        it only on   29.4.2009.     In   such<\/p>\n<p>circumstances, petitioner is not entitled to get<\/p>\n<p>any relief in this petition.
