On 19.1.2010                     Delivered on     30-3-2010\n\n                                             ORDER\n\n8- 30-3-2010                  The instant Criminal Revision is directed against the\n<\/pre>\n<p>               order impugned dated 27.11.2008 passed by the learned Sessions<br \/>\n               Judge, Latehar in S.T. No. 122 of 2008 corresponding to G.R. No.<br \/>\n               89 of 2006 arising out of Chandwa P.S. Case No. 23 of 2006 by<br \/>\n               which     the petition filed on behalf of the petitioners for their<br \/>\n               discharge under section 227 of the Code of Criminal Procedure was<br \/>\n               dismissed. The name of petitioner         Dhananjay Nath Sahi was<br \/>\n               deleted by the order of this Court dated 25.8.2009 on his death.\n<\/p>\n<p>               2.             The prosecution story in short was that                the<br \/>\n               informant-Officer-in-charge of Chandwa police station recorded his<br \/>\n               self statement on 26.2.2006 at about 17.30 hours narrating inter<br \/>\n               alia that on telephonic message received that some extremists had<br \/>\n               been assaulting the pilgrims who had arrived at &#8216; Nagar temple,&#8217; he<br \/>\n               with the police party rushed there and enquired from the<br \/>\n               shopkeepers about the occurrence and only from whom he could<br \/>\n               gather that the extremists      had taken away about 8\/10 pilgrims<br \/>\n               including one Lakhan Prasad Jaiswal with them to unknown place.<br \/>\n               On such information the police party proceeded tracking the retreat<br \/>\n               of the extremists but finding and spotting the police coming<br \/>\n               towards them, the extremists resorted firing which was retaliated<br \/>\n               by the police. Realizing the pressure of the police the extremists<br \/>\n               escaped after releasing the persons who were abducted by them.<br \/>\n               The police party intercepted various incriminating articles including<br \/>\n               literatures, posters, hand bills and note books at some distance<br \/>\n               besides utensils     and empty cartridges to which seizure list was<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>prepared in presence of the witnesses. The statement of the victim<br \/>\nLakhan Prasad Jaiswal was recorded who narrated that he and<br \/>\nother 8\/10 pilgrims were abducted from near the temple by the<br \/>\nextremists on the gun point and they alleged            against Lakhan<br \/>\nPrasad Jaiswal that he was the spy of the police and that he was<br \/>\nbrutally assaulted by them. He further apprised that Biru Yadav,<br \/>\nKrishna Yadav and Tilak Yadav had made arrangement of<br \/>\nbreakfast and meal for the extremists and that they had been<br \/>\nsupplying food to them. In the meantime, extremists escaped after<br \/>\ngun battle with the police party. He disclosed the complicity of<br \/>\nseveral accused persons as extremists, engaged in criminal<br \/>\nactivities of abduction and other crimes, and also implicated the<br \/>\npetitioners Tilak Yadav,Biru Yadav, Krishna Yadav etc.\n<\/p>\n<p>3.            Mr. Jitendra S. Singh, the learned counsel for the<br \/>\npetitioners submitted that the petitioners were innocent and were<br \/>\nnot at all concerned with the alleged offence. The counsel added<br \/>\nthat the statements of several witnesses were recorded in<br \/>\nparagraph 99 of the case diary who were consistent that Lakhan<br \/>\nPrasad Jaiswal was on inimical term with the petitioners on the<br \/>\nground   of   land    disputes,    that   apart,   disputes   related    to<br \/>\nmanagement of        &#8216;Nagar Temple&#8217;. The management of the said<br \/>\ntemple was ultimately transferred in the name of deity with the<br \/>\nconstitution of the trustee committee who looked after the interest<br \/>\nof the properties which were assigned in the name of deity. Mr.<br \/>\nSingh explained that the other victims, who were abducted, such<br \/>\nas Mohat Khan and Chandra Shekhar Pandey and other were also<br \/>\nexamined and     their statements were recorded as contained in<br \/>\nparagraphs 13,14 and 15 of the case diary, who were consistent<br \/>\nby not implicating the petitioners in any manner for their abduction<br \/>\nor otherwise also. However, the allegation that was left out against<br \/>\nthe petitioners was that        they had been supplying food to the<br \/>\nextremists (MC.C.) outlaws. As regards the complicity of                the<br \/>\npetitioner Jago Sao @ Jageshwar Sao @ Yogendra Prasad Sahu<br \/>\nwas concerned, there was no material at all against him except<br \/>\nhis name was found mention in the note books which were<br \/>\nrecovered by the police in course of investigation that          he had<br \/>\ngiven certain amount to the extremists (M.C.C.) and for that the<br \/>\npetitioners cannot be held criminally liable for hatching a criminal<br \/>\nconspiracy against the Union of India. A person cannot be held<br \/>\naccused only on the ground that his name was mentioned in the<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>note book of the extremists as donor without any corroborative<br \/>\nevidence that he was seen by some witnesses delivering certain<br \/>\namount to the M.C.C. people or their agent and therefore, criminal<br \/>\nprosecution of the petitioner Jago Sao @ Jageshwar Sao @<br \/>\nYogendra Prasad Sahu would tantamount to misuse of the process<br \/>\nof the court.\n<\/p>\n<p>4.              Finally Mr Singh submitted with reference to the<br \/>\nFamous &#8216;Hawala Case&#8217; reported in       1998(2) Eastern Criminal<br \/>\nCases 196(SC). The Apex Court in                 Central Bureau of<br \/>\nInvestigation Versus V.C. Shukla and others held :-\n<\/p>\n<blockquote><p>                      &#8220;Even if the entry becomes admissible as<br \/>\n                      relevant evidence, still the statement<br \/>\n                      made therein shall not alone be sufficient<br \/>\n                      evidence to charge any person with<br \/>\n                      liability unless their trustworthiness is<br \/>\n                      corroborated by independent evidence.<br \/>\n                      Entries are not &#8220;admissions&#8221; to attract<br \/>\n                      Section 21 of Evidence Act.&#8221;\n<\/p><\/blockquote>\n<p>5.              The learned A.P.P. opposed the contention as raised<br \/>\non behalf of the petitioners     on the point of discharge for the<br \/>\nalleged offence proposed under sections 364\/120B of the Indian<br \/>\nPenal Code and Section 17 of CLA Act.\n<\/p>\n<p>6.              Having regard to the facts and circumstances of the<br \/>\ncase, I find that the allegation against the petitioners Tilak Yadav,<br \/>\nBiru Yadav and Krishna Yadav was of providing food to the<br \/>\nextremists (M.C.C) outlaws whereas the allegation against the<br \/>\npetitioner Jago Sao @ Jageshwar Sao @ Yogendra Prasad Sahu<br \/>\nwas that his name was found mentioned in the note book which<br \/>\nwas recovered from the hide-out of the extremists containing that<br \/>\nhe was donor and had donated Rs.50,000\/- to them. The learned<br \/>\nA.P.P. failed to point out any other material against the petitioners<br \/>\nin the entire case diary and therefore, on the face value of the<br \/>\nallegation I find that offence as alleged under section 364 read with<br \/>\nsection 120B of the Indian Penal Code is not attracted against the<br \/>\npetitioners Tilak Yadav, Biru Yadav and Krishna Yadav. However, in<br \/>\nthe facts and circumstances of the case I find that there is prima<br \/>\nfacie allegation against the petitioners under section 17 of the CLA<br \/>\nAct which is triable by the Judicial Magistrate, Ist Class. Similarly,<br \/>\nno prima facie offence is made out against the petitioner Jago Sao<br \/>\n@ Jageshwar Sao @ Yogendra Prasad Sahu for the said offence<br \/>\nonly because his name was found mentioned in the note book of<br \/>\nthe Naxalities (M.C.C.) out laws as profounded by the Supreme<br \/>\n<span class=\"hidden_text\">                                   4<\/span><\/p>\n<p>     Court of India in Famous &#8216; Hawala Case&#8217; referred to herein before.<br \/>\n     In the facts and circumstances, the criminal prosecution of the<br \/>\n     petitioner Jago Sao @ Jageshwar Sao @ Yogendra Prasad Sahu,to<br \/>\n     that I subscribe the submission of the counsel, would tantamount<br \/>\n     to misuse of the process of the court as the entry of the name of<br \/>\n     the petitioner Jago Sao @ Jageshwar Sao @ Yogendra Prasad Sahu<br \/>\n     made in the note book is not admissible under the Evidence Act.<br \/>\n     Accordingly, the petitioner Jago Sao @ Jageshwar Sao @ Yogendra<br \/>\n     Prasad Sahu       is discharged from his criminal liability in Chandwa<br \/>\n     P.S. Case No.       23 of 2006 corresponding to G.R. No.        89 of<br \/>\n     2006(S.T. No.      122 of 2008) pending in the court of Sessions<br \/>\n     Judge, Latehar .For the reasons stated above, I find that prima<br \/>\n     facie offence is made out under sections 17 of the CLA Act against<br \/>\n     the petitioners     Tilak Yadav,Biru Yadav and Krishna Yadav and<br \/>\n     accordingly they are directed to be proceeded under such section<br \/>\n     which is triable by the Judicial Magistrate of Ist Class.\n<\/p>\n<p>     7.            With this observation this Criminal Revision is allowed<br \/>\n     in part in the manner indicated above and accordingly, the learned<br \/>\n     Sessions Judge, Latehar is directed to proceed under the provision<br \/>\n     of Section 228(1)(a) Cr.P.C. by transferring the case records of<br \/>\n     concerned to the court of CJM, Latehar.\n<\/p>\n<p>                                                          (D.K.
