Justice KURIAN JOSEPH\n\n Dated :19\/09\/2008\n\n O R D E R\n                           KURIAN JOSEPH, J.\n              - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                       W.P(C).No. 4275 OF 2006\n              - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n             Dated this the 19th day of September, 2008\n\n                                  JUDGMENT\n<\/pre>\n<p>     The Writ Petition is filed with the following prayer:<\/p>\n<p>            i) a writ of mandamus or any other appropriate<\/p>\n<p>      writ, order or direction commanding respondents 1<\/p>\n<p>      to 3 to take coercive action against the 4th<\/p>\n<p>      respondent and to ensure the completion of<\/p>\n<p>      Ottayetti-Thazhathukattupara road as per Ext.P1<\/p>\n<p>      agreement; OR<\/p>\n<p>            a writ of mandamus or any other writ, order or<\/p>\n<p>      direction commanding respondents 1 to 3 to re-<\/p>\n<p>      tender      the       balance          work        of       Ottayetti-<\/p>\n<p>      Thazhathukattupara            road      under        the     PMGSY<\/p>\n<p>      Scheme and to complete the same within a time limit<\/p>\n<p>      and to take steps to recover the loss\/damages<\/p>\n<p>      suffered by the Govt. due to re-tender of balance<\/p>\n<p>      work from the 4th respondent;\n<\/p>\n<p>     In case the petitioners have still any grievance left, they may<\/p>\n<p>approach the 2nd respondent, in which case the 2nd respondent will<\/p>\n<p>take prompt action for the completion of the work.<\/p>\n<p>                                                   (KURIAN JOSEPH, JUDGE)<\/p>\n<p>ttb<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Benchamin Daniel vs The Commissioner For Rural &#8230; on 19 September, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 4275 of 2006(H) 1.
