Civil Application No. 1197 of 2007, the order<br \/>\npassed in the aforesaid petitions on 30.04.07 disposing of the<br \/>\npetitions is recalled and the petitions restored to file   <\/p>\n<p>\tAt the request of<br \/>\nlearned advocate Ms. Nayna Patel, these petitions are taken up for<br \/>\nhearing today.\n<\/p>\n<p>\tThe grievance of the<br \/>\npetitioner is that even though the order passed by the Labour Court,<br \/>\nHimatnagar in Application B.I.R. No. 1 to 4 of 2004 dated 02.05.05<br \/>\nhas been accepted by the respondent-Bank by passing resolution No. 13<br \/>\ndated 21.05.05, no benefits have been paid to the petitioners by the<br \/>\nrespondent Bank. The present petitions have therefore been filed with<br \/>\na prayer to direct the respondent-Bank to implement their resolution<br \/>\nNo. 13 dated 21.05.05 which has not been implemented by the<br \/>\nrespondent Bank for more than 2 years.\n<\/p>\n<p>\tLearned advocate Ms.<br \/>\nNayna Patel submitted that the order passed by the Labour Court,<br \/>\nHimatnagar in Application B.I.R. No. 1 to 4 of 2004 dated 02.05.05 is<br \/>\nnot challenged before the higher forum by the respondent Bank, and no<br \/>\nstay is operating against the aforesaid order, but on the contrary,<br \/>\nthe respondent Bank itself has passed  resolution No. 13 dated<br \/>\n21.05.05 to implement the aforesaid order.\n<\/p>\n<p>\tIn light of the above<br \/>\nbackground, it is directed to the respondent Bank to implement the<br \/>\nresolution No. 13 dated 21.05.05 passed by the respondent Bank and to<br \/>\npay to the petitioners whatever arrears and service benefits and\/or<br \/>\nmonetary benefits available to the petitioners as per the aforesaid<br \/>\norder and resolution, within a period of three months from the date<br \/>\nof receipt of copy of this order.\n<\/p>\n<p>\tAll the four petitions<br \/>\nare disposed of as per the above observations and directions.\n<\/p>\n<p>Mathew<br \/>\n\t\t\t\t\t\t[H.K.RATHOD, J.]<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Dharmishtaben vs Sabarkantha on 12 October, 2010 Author: H.K.Rathod,&amp;Nbsp;
