      Heard both sides.\n<\/p>\n
      2. The revision petitioner who was the counter<\/p>\n
petitioner in M.C.No.14\/2007 on the file of the Sub<\/p>\n
Divisional Magistrate, Devicolam, challenges the final<\/p>\n
order dated 3.1.2008 passed by the Sub Divisional<\/p>\n
Magistrate.\n<\/p>\n
      3. The revision petitioner – Eldhose @ Kunjumon is<\/p>\n
the uncle of one Mahesh Varkey, who has an item of<\/p>\n
property situated at Anaviratty in Vellathooval Village<\/p>\n
bounded on the west by a Panchayat road and on the<\/p>\n
south by a big water channel for the drainage of water.<\/p>\n
Since the said Mahesh Varkey is stated to be abroad, the<\/p>\n
revision petitioner is looking after the said property on<\/p>\n
behalf of his nephew. The eastern boundary of the said<\/p>\n
property is the property of T.J.Joy, the first respondent<\/p>\n
herein   and   the   said     property    does   not extend<\/p>\n

    southwards upto the big water channel. In between the<\/p>\n
    property of T.J.Joy and the southern water channel is<\/p>\n
    the property of the 4th respondent, K.P.Jose Kayikkakudi.<\/p>\n
    Immediately to the east of the property of the first<\/p>\n
    respondent – T.J.Joy is the property of the second<\/p>\n
    respondent – K.J.Kuriachan. The common northern<\/p>\n
    boundary of the property of Mahesh Varkey, T.J.Joy and<\/p>\n
    K.J.Kuriachan is the Adimaly-Munnar National Highway<\/p>\n
    called N.H.49. There is no dispute that the lie of the land<\/p>\n
    is such that it slopes towards south or south – west.<\/p>\n
           4. On 15.5.2007, respondents 1, 2 and 4 herein and<\/p>\n
    one V.J.Mohanan moved the Sub Divisional Magistrate,<\/p>\n
    Devikulam alleging that a thodu which proceeds from the<\/p>\n
    National Highway southwards and turns westwards at the<\/p>\n
    southern boundary of the first respondent’s property and<\/p>\n
    passing through the property of Mahesh Varkey was<\/p>\n
    obstructed by the revision petitioner, who is the uncle of<\/p>\n
    Mahesh Varkey causing inundation of water and deposit<\/p>\n
    of mud and silt in the property of the complainants.<\/p>\n

    They also alleged that the said thodu was used for<\/p>\n
    draining water for the last several years and the revision<\/p>\n
    petitioner who is looking after the property of Mahesh<\/p>\n
    Varkey had filled up portions of the thodu passing<\/p>\n
    through the property of Mahesh Varkey by filling up the<\/p>\n
    same with earth. They further alleged that during the<\/p>\n
    monsoon season, excess water and silt came to be<\/p>\n
    deposited in their property resulting in damage to the<\/p>\n
    paddy cultivation. They, therefore, prayed for appropriate<\/p>\n
    directions for redressel of their grievances.<\/p>\n
           5. The Sub Divisional Magistrate called for a report<\/p>\n
    from the Village Officer Vellathooval. On 2.6.2007, the<\/p>\n
    Village Officer, Vellathooval submitted a report to the<\/p>\n
    following effect:-\n<\/p>\n
           There is a thodu along the culvert, across the<\/p>\n
    National Highway on the north. The said thodu is passing<\/p>\n
    and passing in between the properties of T.J.Joy and<\/p>\n
    K.J.Kuriachan and having a width of 1 metre is meant for<\/p>\n
    draining rain water to the southern water canal. His<\/p>\n

    enquiry with the neighbors revealed that the said thodu<\/p>\n
    after passing southwards was passing through the<\/p>\n
    property of the revision petitioners to eventually reach<\/p>\n
    the southern water canal, situated about 200 meters<\/p>\n
    away and on account of the blockage created by the<\/p>\n
    revision petitioner, there was likelihood of collection of<\/p>\n
    mud and earth and damage the paddy cultivation. The<\/p>\n
    Field Measurement Book pertaining to re-survey does not<\/p>\n
    show the existence of the thodu starting from the<\/p>\n
    National Highway. But the enquiry conducted by him<\/p>\n
    revealed that the thodu, as alleged by the complainants,<\/p>\n
    was in existence for the past 40 years and the water<\/p>\n
    channel which was obstructed by the revision petitioner<\/p>\n
    has to be restored to its original condition. On discussing<\/p>\n
    the matter with the revision petitioner and the<\/p>\n
    complainants, the revision petitioner had objected to the<\/p>\n
    carriage of water through his property but had agreed to<\/p>\n
    construct a new thodu along his eastern boundary so as<\/p>\n
    to reach the southern water canal.\n<\/p>\n

           6. On 27.6.2007, the Sub Divisional Magistrate<\/p>\n
    passed a conditional order under Section 133 Cr.P.C.<\/p>\n
    directing     the  revision petitioner    to   remove  the<\/p>\n
    obstruction caused to the free flow of rain water by<\/p>\n
    blocking the thodu passing through his property and by<\/p>\n
    diverting the course of the water channel and directing<\/p>\n
    the revision petitioner to restore the water channel to its<\/p>\n
    original position or to appear before the Sub Divisional<\/p>\n
    Magistrate on 12.7.2007 and show cause why the<\/p>\n
    conditional     order  should  not   be    made   absolute.<\/p>\n
    Thereafter the Sub Divisional Magistrate, as per the<\/p>\n
    impugned order dated 3.1.2008 made the conditional<\/p>\n
    order absolute, after taking note of the pendency of a<\/p>\n
    suit filed by the revision petitioner as O.S.111 of 2007<\/p>\n
    before the Munsiff Court, Devikulam and after adverting<\/p>\n
    to the statement of witnesses, by name, Shaji, Regi, Anil<\/p>\n
    Kumar and that of the Village Officer, Vellathooval. It is<\/p>\n
    the said order which is assailed in this revision.<\/p>\n
           7. After hearing both sides and perusing the lower<\/p>\n

    court records, I am of the view that if the impugned<\/p>\n
    order is upheld, then it will have the effect of virtually<\/p>\n
    cutting the property of the revision petitioner’s nephew<\/p>\n
    into two segments which may render the property<\/p>\n
    useless. As mentioned earlier, the revision petitioner’s<\/p>\n
    property is bounded on the west by a Panchayat road<\/p>\n
    and on the southern side by the main water canal into<\/p>\n
    which the water collected in the National Highway which<\/p>\n
    is at a higher level is said to eventually reach through<\/p>\n
    the disputed thodu. While there is no dispute regarding<\/p>\n
    that portion of the thodu which run southwards in<\/p>\n
    between the properties of T.J.Joy and K.J.Kuriachan and<\/p>\n
    reaching up to the southern boundary of the property of<\/p>\n
    T.J.Joy, the dispute is really pertaining to the further<\/p>\n
    course of the thodu running from east to west almost<\/p>\n
    through the middle of the revision petitioner’s property.<\/p>\n
    According to the complainants, from the point where the<\/p>\n
    said thodu touches the eastern boundary of the revision<\/p>\n
    petitioner’s property, it was running westwards to reach<\/p>\n

    the Panchayat road and then southwards to reach the<\/p>\n
    southern      water canal.  According   to  the   revision<\/p>\n
    petitioner, there was no thodu passing through his<\/p>\n
    property allowing water to be drained into the southern<\/p>\n
    water canal. But the revision petitioner had made an<\/p>\n
    undertaking before the Village Officer at the time of  his<\/p>\n
    inspection, that he is willing to construct a thodu from<\/p>\n
    the point where the existing thodu touches his eastern<\/p>\n
    boundary, up to the southern water canal along his<\/p>\n
    eastern boundary. Unfortunately, this aspect of the<\/p>\n
    matter has not been gone into by the Sub Divisional<\/p>\n
    Magistrate, who has also not explored the possibility of<\/p>\n
    draining water to the southern water canal along the<\/p>\n
    eastern boundary of the revision petitioner’s property. In<\/p>\n
    case the course of the existing thodu could be directed<\/p>\n
    to the southern water canal through the eastern<\/p>\n
    boundary of the revision petitioner’s property, that may<\/p>\n
    abate the nuisance alleged by the respondents 1 to 4.<\/p>\n
    That is certainly a possible alignment which can cause<\/p>\n

    least hardship and inconvenience to all the parties. If the<\/p>\n
    problem of inundation of water and collection of earth on<\/p>\n
    account of the blockage at the disputed point could be<\/p>\n
    got over by extending the thodu along with the eastern<\/p>\n
    boundary of the revision petitioner’s property, that will<\/p>\n
    certainly solve the problem faced by the respondents 1 to<\/p>\n
    4 herein. Such an alternative alignment can allay the<\/p>\n
    heartburn caused to the revision petitioner also. I,<\/p>\n
    therefore, set aside the final order dated 3.1.2008<\/p>\n
    passed by the Sub Divisional Magistrate and remit the<\/p>\n
    matter to the Sub Divisional Magistrate to explore the<\/p>\n
    possibilities of the aforementioned or any other alternate<\/p>\n
    alignment which may cause the least inconvenience to<\/p>\n
    either parties. In case after considering the topography<\/p>\n
    of the land,       water could be drained through the<\/p>\n
    aforementioned or any other alternate alignment, that<\/p>\n
    can be the best possible solution to this problem. Both<\/p>\n
    the parties shall adduce evidence to show whether the<\/p>\n
    above alternate course could be adopted so that there is<\/p>\n

    no heartburn for either side. The sub Divisional<\/p>\n
    Magistrate shall call for a report from the Village Officer<\/p>\n
    during the ensuing monsoon and may also conduct a<\/p>\n
    local inspection, if necessary.\n<\/p>\n
           The Revision Petition is allowed as above.<\/p>\n
