The learned Counsel appearing for<br \/>\nthe petitioner<br \/>\nsubmitted that in pursuance of detention under sub-section 1 of<br \/>\nSection 207, an application under Sub-Section 2 of Section 207 of the<br \/>\nMotor Vehicles Act, 1988 shall be preferred by the petitioner<br \/>\nto the respondent authority or any other officer authorized by the<br \/>\nState Government for detention\/ seizure of the vehicle in question.<br \/>\nAs the petitioner<br \/>\nhas not approached the authority as per the sub-section 2 of section<br \/>\n207, till then the interim relief is refused.\n<\/p>\n<p>During<br \/>\n\tthe course of hearing, Mr.J.K. Shah, learned Assistant Government<br \/>\n\tPleader, has pointed out that till date, no such application as<br \/>\n\tindicated in the aforesaid order has been made by the petitioner<br \/>\n\tand even the learned advocate for the petitioner has<br \/>\n\tadmitted the said aspect.\n<\/p>\n<p>Thus,<br \/>\n\twhen the petitioner<br \/>\n\thas not made any statutory application for release of his vehicle<br \/>\n\tunder the provisions of the Act, it will not be possible for this<br \/>\n\tCourt to entertain this petition since the prescribed procedure for<br \/>\n\tgetting compensation has not been followed by the petitioner.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid, the present petition fails and is, accordingly,<br \/>\n\tdismissed. Rule is discharged with no order as to costs.
