    Defendants in O.S.No.277\/1990 on the file of<\/p>\n
Munsiff   court,    Thalassery     are   appellants.<\/p>\n
Plaintiff is respondent. Respondent instituted<\/p>\n
the suit seeking a decree for injunction.    Plaint<\/p>\n
schedule  property    is     a  shop   building   in<\/p>\n
R.S.No.18\/1 of Thalassery village.     It admittedly<\/p>\n
originally   belonged      to   Kumbakaroth   Koran.<\/p>\n
According to respondent, under Ext.A1 assignment<\/p>\n
deed, he purchased the     property on 7.2.1973 and<\/p>\n
the upstair portion of building which consists of<\/p>\n
two rooms and a common verandah was rented out to<\/p>\n
Kunnoth Branch of Indian Union     Muslim League on<\/p>\n
a  monthly  rent   of    Rs.50\/-.     According   to<\/p>\n
respondent, monthly rent was paid upto August<\/p>\n
1989 and thereafter Muslim League          Committee<\/p>\n
surrendered  possession      of  the   building   in<\/p>\n

  November, 1989 and there was a fire in the<\/p>\n
  building         whereunder  portion  of   the  roof<\/p>\n
  including      windows  and  doors  were  destroyed.<\/p>\n
  Contending      that  respondents  who   are  office<\/p>\n
  bearers of Sunni Students Federation and Sunny<\/p>\n
  Yuvagana Sangh      have no right over the property<\/p>\n
  and attempted to trespass into the property, a<\/p>\n
  decree for injunction was sought for.     Appellants<\/p>\n
  in     their    written   statement  contended  that<\/p>\n
  building 2\/63 in the upstair was taken on rent by<\/p>\n
  the President and Secretary of S.Y.S on a rent of<\/p>\n
  Rs.7\/- in 1969 from Kumbakkoroth Koran     and since<\/p>\n
  then they are in possession of property and<\/p>\n
  therefore      respondent  is  not entitled  to  the<\/p>\n
  decree       in respect  of   that  portion  of  the<\/p>\n
  building.\n<\/p>\n
        2. Learned Munsiff on the    evidence of PWs.1<\/p>\n
  to 4, Exts.A1 to A2(e) DWs.1 and 2 and Exts.B1 to<\/p>\n
  B5 and Exts.C1 and C2 granted a decree in favour<\/p>\n
  of respondent finding that appellants are not<\/p>\n
  tenants as claimed and they have no right over<\/p>\n

  the building      and the rooms are in the possession<\/p>\n
  of    respondents.      Appellants    challenged   the<\/p>\n
  decree and judgment before Sub court, Thalassery<\/p>\n
  in     A.S.219\/1992.        Learned   Sub   Judge   on<\/p>\n
  reappreciation of evidence confirmed the findings<\/p>\n
  of learned Munsiff and dismissed the appeal.       It<\/p>\n
  is challenged in the second appeal.<\/p>\n
        3.       Appeal  was  admitted formulating   the<\/p>\n
  following substantial questions of law.<\/p>\n
        1.     When defendants are in settled possession<\/p>\n
  of plaint schedule property, can a plaintiff file<\/p>\n
  a suit for injunction, to dispossess them by<\/p>\n
  unlawful methods.\n<\/p>\n
        2.      When Commissioner submitted a report<\/p>\n
  without notice to defendants and later again<\/p>\n
  filed a report after inspection with notice to<\/p>\n
  the     parties,    whether  court  is  justified   in<\/p>\n
  accepting the first report.\n<\/p>\n
        4.     Learned counsel appearing for appellants<\/p>\n
  was    heard.\n<\/p>\n
        5.    Advocate   Mr.K.V.Sohan, learned   counsel<\/p>\n

  appearing for appellants vehemently argued that<\/p>\n
  Ext.B3 scene mahazar prepared by Sub Inspector of<\/p>\n
  Police, Dharamadam Police Sttion establish that<\/p>\n
  appellants were in possession of property when<\/p>\n
  Sub Inspector inspected the property and courts<\/p>\n
  below      should  not  have  ignored  that  valuable<\/p>\n
  evidence.      Learned counsel argued that respondent<\/p>\n
  did not establish possession and evidence of<\/p>\n
  respondent     establish   their that  S.Y.S  was   a<\/p>\n
  tenant of one of the shop room in the upstair<\/p>\n
  bearing      door No.2\/63 and therefore the decree<\/p>\n
  granted      in  respect  of  the  said  building  is<\/p>\n
  unsustainable.\n<\/p>\n
        6.      The  fact  that  building    originally<\/p>\n
  belonged      to  Kumbakaroth    Koran  is  admitted.<\/p>\n
  Under Ext.A1 the property including the building<\/p>\n
  was assigned by Kumbakaroth Koran in favour of<\/p>\n
  respondent on 7.2.1973.       What was contended by<\/p>\n
  respondent was that the entire upstair building<\/p>\n
  which consists of two rooms bearing door No.2\/62<\/p>\n
  and 2\/63 of Thalassery Municipality were taken on<\/p>\n

  rent by Indian Union Muslim League       and tenant<\/p>\n
  was in possession till it was surrendered in<\/p>\n
  November, 1989. The case of appellants is that<\/p>\n
  room No.2\/62 was obtained by then office bearers<\/p>\n
  of Sunni Yuvagana Sangha from the original owner<\/p>\n
  Kumbakaroth Koran in 1969.        Courts below on<\/p>\n
  appreciating the evidence found that there is no<\/p>\n
  evidence to substantiate the lease or possession<\/p>\n
  of appellants.     Appellants did not examine Koran<\/p>\n
  to prove that there was a lease.     Though Exts.B1<\/p>\n
  series of rent receipts were produced, without<\/p>\n
  examination of the     landlord, receipts cannot be<\/p>\n
  relied on.     Though learned counsel appearing for<\/p>\n
  appellants argued that Ext.B3 mahazar prepared by<\/p>\n
  police in Crime 112\/1989 of Dharmadam police<\/p>\n
  station establish possession of appellant, as<\/p>\n
  rightly found by courts below without proving<\/p>\n
  Ext.B3 by executing the another, recitals therein<\/p>\n
  cannot be relied on.     Appellants did not examine<\/p>\n
  either      the Sub  Inspector,  who  prepared  the<\/p>\n
  mahazar or any of the attesting    witnesses to the<\/p>\n

  scene mahazar.       In such circumstance, courts<\/p>\n
  below found that Ext.B3 cannot be relied on and<\/p>\n
  appellants were not the tenants of the building<\/p>\n
  as claimed by them.\n<\/p>\n
        7. On the evidence trial court and first<\/p>\n
  appellate court found that respondent has been in<\/p>\n
  possession of the plaint schedule property and<\/p>\n
  appellants have no manner of right or possession<\/p>\n
  over     property and granted the decree.  There is<\/p>\n
  no evidence to prove that appellants were in<\/p>\n
  possession      of property much less in settled<\/p>\n
  possession of property.     Respondent is therefore<\/p>\n
  entitled to the decree granted by the        courts<\/p>\n
  below. There is no merit in the appeal.      It is<\/p>\n
  dismissed. No cost.\n<\/p>\n<\/p>\n
