M. SAHAI)<\/a><\/p>\n<p>1.\tWe have<br \/>\nheard learned counsel Mr. Nitin M. Amin for the petitioner and<br \/>\nlearned Assistant Government Pleader Mr. N.J. Shah for the<br \/>\nrespondent.\n<\/p>\n<p>2.\tThis<br \/>\npetition has been filed by the petitioner on the ground that his<br \/>\napplication under Section 28A of the Land Acquisition Act (for short,<br \/>\n&#8216;the Act&#8217;) has not been decided in spite of the direction of this<br \/>\nCourt issued on 15.2.2011 in Special Civil Application No.10564 of<br \/>\n2007 to Special Civil Application No.10579 of 2007.\n<\/p>\n<p>3.\tThe<br \/>\napplication under Section 28A of the Act was not decided by the<br \/>\nrespondent on the ground that they have filed First Appeal before<br \/>\nthis Court challenging the award passed by the Reference Court under<br \/>\nSection 18 of the Act.\n<\/p>\n<p>4.\tWe are<br \/>\nof the opinion that the respondent contemptuously did not decide the<br \/>\napplication of the petitioner under Section 28A of the Act as<br \/>\npendency of the appeal would not amount to staying the proceedings<br \/>\nunder Section 28A of the Act. However, now, though the first appeals<br \/>\nhave also been decided by this Court, the application of the<br \/>\npetitioner under Section 28A of the Act has not been decided. The<br \/>\nground taken by the respondent earlier was that no intimation has<br \/>\nbeen received by them from the learned Assistant Government Pleader<br \/>\nor the State Government for deciding the application under Section<br \/>\n28A of the Act.\n<\/p>\n<p>5.\tBe that<br \/>\nas it may, the learned Assistant Government Pleader  states that the<br \/>\napplication of the petitioner under Section 28A of the Act would be<br \/>\ndecided on merits by the concerned officer by reasoned and speaking<br \/>\norder within a period of three months from today.\n<\/p>\n<p>6.\tThis<br \/>\npetition is disposed of with the direction to the respondent to<br \/>\ndecide the application of the petitioner under Section 28A of the Act<br \/>\nby reasoned and speaking order within a period of three months from<br \/>\ntoday in accordance with law.
