JUSTICE ARVIND KUMAR<\/p>\n<p>Present:-   Mr. B.S.Sra, DAG Punjab<\/p>\n<p>            None for the respondents.\n<\/p>\n<p>                   &#8230;\n<\/p>\n<p>ARVIND KUMAR, J:\n<\/p>\n<p>            The present appeal is by the State of Punjab         against the<br \/>\njudgment dated 22.7.1996 passed by the Judicial Magistrate I Class,<br \/>\nPathankot, by dint of which the respondents-accused have been acquitted of<br \/>\nthe charges under Sections 420, 467, 468 and 471 IPC.\n<\/p>\n<p>            The facts relevant are that on 18.7.1988, a written complaint<br \/>\nwas made by S.S.Passi Deputy State Employment Officer, Amritsar (Camp<br \/>\nGurdaspur) to the Senior Superintendent of Police, Gurdaspur, stating<br \/>\ntherein that an interview was arranged for the selection of Beldars at R.S.D.<br \/>\nShahpur Kandi on 30.6.1988. As per the instructions of the department, the<br \/>\nvacancies were to be filled through interview from amongst the candidates<br \/>\nmentioned in Annexures A &amp; B supplied by Employment Exchange<br \/>\nGurdaspur and Batala respectively. The Organisers expressed their doubt<br \/>\nregarding the veracity of the lists supplied by the exchanges and, therefore,<br \/>\nthey sent their representative to the Employment Exchanges for verification.<br \/>\nOn verification, it came to notice that the lists received at the Dam were<br \/>\ntampered with and a number of names were included therein by forgery. On<br \/>\ninstructions from the complainant, the Employment Officer, Gurdaspur<br \/>\nalong   with his office Superintendent and Assistant of the office of<br \/>\nEmployment Officer Batala reached Shahpur Kandi for investigation and<br \/>\nthe factum regarding receipt of bogus lists was found to be true.       The<br \/>\nInvestigating Officer    took in custody certain interview cards of the<br \/>\ncandidates, which bore forged signatures. The statements of the said<br \/>\n<span class=\"hidden_text\"> Crl. A. No. 171-SBA of 1997                                    -2-<\/span><br \/>\ncandidates were recorded in which they disclosed that they had purchased<br \/>\nthe interview cards for a sum ranging between Rs.500\/- to Rs.700\/-. A<br \/>\nseparate annexure giving the names and details was also appended District<br \/>\nEmployment Officer, Gurdaspur brought all the aforesaid         facts to the<br \/>\nnotice of the Director, Employment Department, Punjab, who directed him<br \/>\nto lodge an FIR in this connection. Thereafter, on the basis of afore-stated<br \/>\ncomplaint a case under Sections 420, 467, 468 and 471 IPC was registered<br \/>\nagainst the respondents-accused. On completion of investigation, the<br \/>\naccused were challaned. On being charge-sheeted under the afore-stated<br \/>\nSections, by the Judicial Magistrate I Class, Pathankot, the respondents-<br \/>\naccused pleaded not guilty and claimed trial. During the trial, the<br \/>\nprosecution produced as many as 23 witnesses in all. Thereafter, the<br \/>\nincriminating material was put to the respondents-accused when their<br \/>\nstatement under Section 313 Cr.P.C. was recorded. They denied all of them<br \/>\nand pleaded false implication. No evidence in defence was led by them.\n<\/p>\n<p>            After hearing the learned Public Prosecutor as well as learned<br \/>\ndefence counsel, the trial court came to the conclusion that the material<br \/>\nproduced on the record by the prosecution does not inspire confidence,<br \/>\nconnecting the accused with the alleged commission of crime and<br \/>\naccordingly acquitted the respondents. Hence, this appeal by the State of<br \/>\nPunjab.\n<\/p>\n<p>            I have heard learned State counsel and have also gone through<br \/>\nthe record. No one has put in appearance on behalf of the respondents.\n<\/p>\n<p>            The learned trial Court while acquitting the accused-<br \/>\nrespondents observed that if the prosecution witnesses had paid money to<br \/>\naccused Bishan Dass and other accused as bribe to get issued the interview<br \/>\ncards, then they themselves are the accomplice and the statements of such<br \/>\naccomplice could not be believed as per Section 114(b) of the Indian<br \/>\nEvidence Act which provides that an accomplice is unworthy of credit<br \/>\nunless he is corroborated in material particulars. Trial Court found that the<br \/>\noriginal interview cards alleged to be forged one, were never taken into<br \/>\npossession by the Investigating Officer and even in the preliminary enquiry,<br \/>\nno effort was made to recover the said interview cards, which was the<br \/>\nprimary evidence and the same having not been produced in Court, it could<br \/>\nnot be held that the respondents-accused had forged the interview cards.\n<\/p>\n<p><span class=\"hidden_text\"> Crl. No. 171-SBA of 1997                                    -3-<\/span><\/p>\n<p>Moreover, accused Hardit Singh had made disclosure statement, Exhibit<br \/>\nPW 14\/A but still, no effort was made to collect evidence regarding the<br \/>\nprinting press from where the said cards were got printed and at whose<br \/>\ninstance the same were got printed. Trial Court also observed that the<br \/>\nreport of the Inquiry Officer in the preliminary enquiry does not inspire<br \/>\nconfidence being hearsay evidence as the accused-respondents were never<br \/>\njoined in the same. More so, the departmental enquiry could not be made<br \/>\nthe basis for recording conviction in a criminal case, though it may be<br \/>\ntreated as supporting evidence.     Trial Court further observed that the<br \/>\nprosecution witnesses who allegedly paid money to accused Bishan Dass<br \/>\nwere not entered with the Employment Exchange. The High Court ought not<br \/>\nto interfere with the order of acquittal unless the judgment of acquittal is<br \/>\nperverse or highly unreasonable. In the instant case, the judgment of<br \/>\nacquittal rendered by Judicial Magistrate I Class, Pathankot, is neither<br \/>\nperverse nor unreasonable and it cannot be said that the trial court based its<br \/>\nfindings on irrelevant or inadmissible evidence.
