Justice C.N.RAMACHANDRAN NAIR\n\n Dated :19\/08\/2009\n\n O R D E R\n             C.N.RAMACHANDRAN NAIR, J\n                - - - - - - - - - - - - - - - - - - - - - - -\n                 W.P.(C) No.2822 of 2005\n            - - - - - - - - - - - - - - - - - - - - - - - -\n        Dated this the 19th day of August, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>     Petitioner is challenging demand of contribution<\/p>\n<p>towards Motor Transport Workers Welfare Fund dues from<\/p>\n<p>1987 to 1990 contending that the employees for whom the<\/p>\n<p>demand is raised were partners. However, petitioner failed<\/p>\n<p>to produce the partnership deed before the lower<\/p>\n<p>authorities and even a copy is not available.                   Further<\/p>\n<p>learned standing counsel pointed out from Ext.P1 order that<\/p>\n<p>one of the employeeS at least gave statement that he was<\/p>\n<p>an employee working in the stage carriage FOR 14 years<\/p>\n<p>and was never a partner.              I do not think there is any<\/p>\n<p>bonafides in the case of the petitioner because partnership<\/p>\n<p>remains unsubstantiated. Recovery is therefore possible,<\/p>\n<p>from the petitioner.
