A.L.DAVE\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/10\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE J.B.PARDIWALA)<\/p>\n<p>\tIn<br \/>\nthis Appeal, the appellants &#8211; original petitioners seek to<br \/>\nchallenge the judgment and order dated 3rd December 2010<br \/>\npassed by the learned Single Judge in Special Civil Application<br \/>\nNo.15416 of 2010, whereby the learned Single Judge rejected the<br \/>\npetition having found no substance.\n<\/p>\n<p>\tFacts<br \/>\nrelevant for the purpose of deciding the present Appeal can be<br \/>\nsummarised as under :-\n<\/p>\n<p>Record<br \/>\n\treveals that the respondents preferred a suit under the Mamlatdar&#8217;s<br \/>\n\tCourt Act, which came to be registered as Mamlatdar&#8217;s Court Act Case<br \/>\n\tNo.2 of 2009, claiming right of way through the land of the<br \/>\n\tappellants herein bearing Block No.314 for the purpose of ingress to<br \/>\n\ttheir land bearing Block No.310.\n<\/p>\n<p>It<br \/>\n\tappears that the respondents also filed an application for interim<br \/>\n\tinjunction. The appellants filed reply to the interim injunction<br \/>\n\tapplication preferred by the respondents and the Mamlatdar<br \/>\n\tconsidered the reply of the appellants to the interim injunction<br \/>\n\tapplication as final reply and passed order in Mamlatdar&#8217;s Court Act<br \/>\n\tCase No.2 of 2009, allowing the suit preferred by the respondents<br \/>\n\tand granting relief as prayed for by the respondents.\n<\/p>\n<p>Aggrieved<br \/>\n\tby the said judgment and order passed by the Mamlatdar, the<br \/>\n\tappellants herein preferred Revision Application No.4 of 2010 before<br \/>\n\tthe Deputy Collector. The Deputy Collector rejected the Revision<br \/>\n\tApplication No.4 of 2010, confirming the order passed by the<br \/>\n\tMamlatdar. It is at that stage that the appellants &#8211; original<br \/>\n\tpetitioners preferred Special Civil Application no.15416 of 2010.\n<\/p>\n<p>Before<br \/>\n\tthe learned Single Judge the grievance voiced by the appellants was<br \/>\n\tthat the Mamlatdar did not grant them an opportunity to file reply<br \/>\n\tand the Mamlatdar could not have considered the reply filed by the<br \/>\n\tappellants to the interim injunction application as final reply to<br \/>\n\tthe suit preferred by the respondents.\n<\/p>\n<p>\tThis<br \/>\ncontention did not weigh with the learned Single Judge, and to our<br \/>\nmind, very rightly, as there was no satisfactory reply at the end of<br \/>\nthe appellants as to why the appellants were not able to file any<br \/>\nreply from 26th May 2009 to 25th September<br \/>\n2009.\n<\/p>\n<p>\tBe<br \/>\nthat as it may, what is important in the present Appeal is as to<br \/>\nwhether the same is maintainable under Clause 15 of the Letters<br \/>\nPatent or not.\n<\/p>\n<p>\tIt<br \/>\nis evident from the pleadings and the relief as prayed for by the<br \/>\nappellants that the main petition was a petition under Article 227 of<br \/>\nthe Constitution of India, invoking supervisory jurisdiction of the<br \/>\nHigh Court.
