The first appellant and his son from\t his\nfirst  wife  were tried for the murder of the  deceased\t and\nalso  for  subjecting  her  to\tcruelty.  The  trial   court\nconvicted both of the them under section 302 and 498-A\tread\nwith Section 34 of the Indian Penal Code on the basis of the\ndying  declaration made by the deceased before the  Judicial\nMagistrate.  The  High Court, on  appeal,  maintained  their\nconviction and sentence under Section 302 read with  Section\n34 Indian Penal Code but acquitted them of the offence under\nSection 198-A read with Section 34.\n     In\t the  appeal,  by special leave, on  behalf  of\t the\nappellants-accused it was contended that the statement\tmade\nby  the deceased before the doctor, who had admitted her  in\nthe  hospital,\tgiving cause of her death as  burn  injuries\nsustained  by  her while cooking food on gas stove  was\t the\nearliest  version and amounted to a dying  declaration,\t and\nthere  being  two  contradictory  statements  made  by\t the\ndeceased,  the dying declaration recorded by the  magistrate\nwas  not worthy of credit and conviction of  the  appellants\ncould not be based on it.\n     Dismissing the appeal, this Court,\n     HELD  : 1.1. The conviction of the appellants is  based\non  the\t dying\tdeclaration  made by  the  deceased  in\t the\nhospital before a Judicial Magistrate. The doctor  certified\nthat the patient remained conscious\n\t\t\t\t\t\t       911\nduring\tthe period her statement was recorded. The  Judicial\nMagistrate recorded a certificate that the statement of\t the\ndeceased  was recorded by him and it contained true  version\nof her statement and she had thumb marked the same. In\tview\nof  the doctor's certificate, there is no infirmity  in\t the\nrecording of the dying declaration by the magistrate and the\nsame inspires confidence. [912 C-D]\n     1.2  It was the first appellant who brought  his  wife,\ndeceased, to the hospital and he remained present while\t the\ndeceased was examined by the doctor. It is nowhere mentioned\nin  the\t record\t that what was recorded by  the\t doctor\t was\nstated by the deceased. Therefore, what was recorded by\t the\ndoctor could not be the version of deceased herself. Had  it\nbeen  so,  the doctor may not have used the  word  \"alleged\"\nwhile  recording  that the patient received  injuries  while\ncooking\t food  in  gas-stove. The doctor,  did\tnot  mention\nanywhere  of  the  record about the state  of  mind  of\t the\ndeceased,  whether  she\t was conscious or not.\tIt  is\tmore\nprobable  that\twhat was recorded by the doctor was  at\t the\ninstance of the husband who was accompanying his wife at the\ntime of her examination by him. Therefore, the courts  below\nhave  rightly  rejected\t the  defence  plea  that  what\t was\nrecorded by the doctor was at the instance of the  deceased.\nThe  trial court has also rightly rejected the\tevidence  of\ndefence witnesses. There is no infirmity in the judgments of\nthe courts below. [1912 G-H, 913 A-C]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     CRIMINAL  APPELLATE JURISDICTION : Criminal Appeal\t No.<br \/>\n150 of 1992.\n<\/p>\n<p>     From  the\tJudgment and Order dated  21.8.1991  of\t the<br \/>\nPunjab and Haryana High Court in Criminal Appeal No.  210-DB<br \/>\nof 1989.\n<\/p>\n<p>     U.R.  Lalit,  B.S.\t Katial and S.\tMuralidhar  for\t the<br \/>\nAppellants.\n<\/p>\n<p>     Ms. Indu Malhotra for the Respondent.\n<\/p>\n<p>     The following order of the Court was delivered :<br \/>\n     Sheema,  second  wife  of\tappellant  Surinder Kumar,<br \/>\nsustained  70 per cent burn injuries in an occurrence  which<br \/>\ntook place of May 16, 1987 and ultimately succumbed to those<br \/>\ninjuries on May 22, 1987. Surinder Kumar and his son  Sanjiv<br \/>\nfrom his first wife were tried for the murder of Sheema\t and<br \/>\nalso  for  subjecting  her  to\tcruelty.  The  trial   court<br \/>\nconvicted both of them under Sections 302\/34 and 498-A\/34 of<br \/>\nthe Indian Penal Code. They<br \/>\n<span class=\"hidden_text\">\t\t\t\t\t\t       912<\/span><br \/>\nwere sentenced for life and a fine of Rs. 500  on the  first<br \/>\ncount and rigorous imprisonment for two years and a fine  of<br \/>\nRs.  200  on the second count. The High\t Court,\t on  appeal,<br \/>\nmaintained  their  conviction  and  sentence  under  Section<br \/>\n302\/34 Indian Penal Code. They were, however, acquitted\t  by<br \/>\nthe High Court of the offence under Section 498-A\/34  Indian<br \/>\nPenal  Code. This appeal by way of special leave is  by\t the<br \/>\nappellants against their conviction and sentence.\n<\/p>\n<p>     The conviction of the appellants is based on the  dying<br \/>\ndeclaration  made by the deceased in the hospital  before  a<br \/>\nJudicial. Magistrate. The doctor certified that the  patient<br \/>\nremained  conscious  during  the period\t her  statement\t was<br \/>\nrecorded.  The\tjudicial Magistrate recorded  a\t certificate<br \/>\nthat  the  statement of Sheema was recorded by\thim  and  it<br \/>\ncontained  true version\t of her statement and she had  thumb<br \/>\nmarked the same. We have been taken through the text of\t the<br \/>\ndying  declaration.  We are satisfied that in  view  of\t the<br \/>\ndoctor&#8217;s certificate, there is no infirmity in the recording<br \/>\nof  the\t  dying declaration by the magistrate and  the\tsame<br \/>\ninspires confidence.\n<\/p>\n<p>     Mr.  U.R. lalit, learned senior advocate appearing\t for<br \/>\nthe  appellants\t has  vehemently contended  that  Dr.  Ashok<br \/>\nTandon\twho admitted the deceased in the  hospital  recorded<br \/>\nthat the patient `allegedly&#8217; got burns while cooking food on<br \/>\ngas-stove. Mr. Lalit further contended that Dr. Ashok Tandon<br \/>\nappearing  as  PW  11 has deposed that at the  time  of\t his<br \/>\nexamination the patient was conscious and she told him\tthat<br \/>\nshe  got the burn injuries while cooking food on  gas-stove.<br \/>\nMr.  Lalit  has\t argued that the statement  made  by  Sheema<br \/>\nbefore the doctor giving cause of her death is the  earliest<br \/>\nversion and amounts to a dying declaration. According to him<br \/>\nthere being two contradictory statements by the deceased the<br \/>\ndying  declaration recorded by the Magistrate is not  worthy<br \/>\nof  credit and conviction of the appellants cannot be  based<br \/>\non the same. We do not agree. it was accused Surinder  Kumar<br \/>\nwho brought his wife Sheema to the hospital and he  remained<br \/>\npresent while the deceased was examined by the doctor. It is<br \/>\nnowhere\t mentioned in the record that what was\trecorded  by<br \/>\nthe  doctor was stated by the deceased. it is  evident\tthat<br \/>\nwhat was recorded by Dr. Tandon could not be the version  of<br \/>\nSheema herself. Had it been so the doctor may not have\tused<br \/>\nthe word &#8220;alleged&#8221; while recording that the patient received<br \/>\ninjuries while cooking food on gas-stove. Dr. Tandon did not<br \/>\nmention\t anywhere on the record about the state of  mind  of<br \/>\nSheema. It was nowhere recorded whether she was conscious or<br \/>\nnot. It is difficult<br \/>\n<span class=\"hidden_text\">\t\t\t\t\t\t       913<\/span><br \/>\nto believe that the doctor made his deposition in the  court<br \/>\non  the basis of his memory. it is more probable  that\twhat<br \/>\nwas  recorded  by  Dr. Tandon was at  the  instance  of\t the<br \/>\nhusband\t who  was accompanying his wife at the time  of\t her<br \/>\nexamination  by Dr. Tandon. On the above reasoning both\t the<br \/>\ncourts\tbelow have rejected the defence argument  that\twhat<br \/>\nwas recorded by Dr. Ashok Tandon was at the instance of\t the<br \/>\ndeceased.  We see no ground to differ with  the\t conclusions<br \/>\nreached by the courts below.\n<\/p>\n<p>     Mr.  Lalit\t has  further argued that  the\tevidence  of<br \/>\ndefence\t witnesses was not taken into consideration  by\t the<br \/>\nHigh  Court.  We  have read the\t statement  of\tthe  defence<br \/>\nwitnesses  along  with Mr. Lalit. We are  not  impressed  by<br \/>\ntheir  testimony.
