SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/11\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>Leave<br \/>\n\tto amend the cause title.\n<\/p>\n<p>Rule.\n<\/p>\n<p>\tMr.Murali Devnani, learned advocate waives service of notice of rule<br \/>\n\ton behalf of respondent No.1 &#8211; original complainant and<br \/>\n\tMr.M.R.Mengdey, learned Additional Public Prosecutor waives service<br \/>\n\tof notice of rule on behalf of respondent No.2 &#8211; State.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case and with the consent of the<br \/>\n\tlearned advocates appearing on behalf of the respective parties and<br \/>\n\tas it is reported that parties have settled the dispute and entire<br \/>\n\tamount under the cheque in question, for which judgement and order<br \/>\n\tof conviction has been passed, has been fully paid up and as the<br \/>\n\tpetitioner is ready and willing to pay\/deposit 15% amount of the<br \/>\n\ttotal amount under cheque in question towards cost to be deposited<br \/>\n\twith the Gujarat High Court Legal Services Committee, present<br \/>\n\tCriminal Revision Application is taken up for final hearing today.\n<\/p>\n<p>Present<br \/>\n\tCriminal Revision Application, under Section 397 read with Section<br \/>\n\t401 of the Code of Criminal Procedure, has been preferred by the<br \/>\n\tpetitioner &#8211; original accused challenging the judgement and<br \/>\n\torder dated 29\/09\/2010 passed by learned Additional District Judge<br \/>\n\tand FTC No.2, Nadiad in Criminal Appeal No.18 of 2010 as well as the<br \/>\n\tjudgement and order dated 05\/02\/2010 passed by the learned Judicial<br \/>\n\tMagistrate (First Class), Dakor in Criminal Case No.1154 of 2003, by<br \/>\n\twhich, the petitioner has been convicted for the offence punishable<br \/>\n\tunder Section 138 of the Negotiable Instruments Act (hereinafter<br \/>\n\treferred to as &#8220;N.I.Act&#8221;) and is sentenced to undergo<br \/>\n\trigorous imprisonment for a period of one years and is also directed<br \/>\n\tto pay a sum of Rs.3,000\/- towards fine and is further directed to<br \/>\n\tpay total a sum of Rs.3,50,000\/- towards compensation.\n<\/p>\n<p>Today<br \/>\n\twhen the present Criminal Revision Application is taken up for final<br \/>\n\thearing, learned Advocates appearing on behalf of the respective<br \/>\n\tparties more particularly learned advocate appearing on behalf of<br \/>\n\tthe complainant- respondent No.1 as well as original accused &#8211;<br \/>\n\tpetitioner herein have jointly submitted that in the facts and<br \/>\n\tcircumstances of the case and as the entire amount was to be paid<br \/>\n\tand the said amount was to be received by the society, the matter is<br \/>\n\tsettled between the parties and learned<br \/>\n\tadvocate appearing on behalf of the respondent No.1 &#8211; original<br \/>\n\tcomplainant has stated at the bar that he has no objection if the<br \/>\n\toffence is permitted to be compounded and the impugned judgement and<br \/>\n\torders passed by both the Courts below are quashed and set aside on<br \/>\n\tany condition that may be imposed by this Court.\n<\/p>\n<p>learned<br \/>\n\tadvocates appearing on behalf of the respective parties have<br \/>\n\theavily relied upon the decision of the<br \/>\n\tHon&#8217;ble Supreme Court  in the case of Damodar S. Prabhu<br \/>\n\tVersus Sayed Babalal H.,  reported in (2010)5 SCC 663 and<br \/>\n\thave requested to permit the respective parties to compound the<br \/>\n\toffence and quash and set aside the impugned judgement and orders<br \/>\n\tpassed by both the Courts below.\n<\/p>\n<p>Mr.Dholakia,<br \/>\n\tlearned advocate appearing on<br \/>\n\tbehalf of the petitioner &#8211; original accused has stated<br \/>\n\tat the bar that  the entire amount of Rs.4,48,000\/- due and payable<br \/>\n\tunder the cheque in question, for which, offence under Section 138<br \/>\n\tof the N.I.Act was registered, and for which the petitioner has been<br \/>\n\tconvicted, has been paid. The aforesaid statement is confirmed by<br \/>\n\tMr.Murali Devnani, learned advocate appearing on behalf of<br \/>\n\trespondent No.1 &#8211; original complainant. He has produced on<br \/>\n\trecord xerox copy of the Certificate issued by respondent No.1<br \/>\n\tSociety &#8211; original complainant dated 20\/11\/2010 certifying<br \/>\n\tthat the entire amount due and payable under the cheque in question<br \/>\n\thas been paid. The same is directed to be taken on record.\n<\/p>\n<p>Mr.Dholakia,<br \/>\n\tlearned advocate appearing on<br \/>\n\tbehalf of the petitioner has stated at the bar that he has<br \/>\n\tbrought Demand Draft of Rs.67,200\/- in favour of Gujarat High Court<br \/>\n\tLegal Services Committee, being  15% of the total amount due and<br \/>\n\tpayable under the cheque in question, towards costs, which is to be<br \/>\n\tpaid, as observed by the Hon&#8217;ble<br \/>\n\tSupreme Court in the case of Damodar S. Prabhu. (Supra).\n<\/p>\n<p>Mr.Dholakia,<br \/>\n\tlearned advocate appearing on<br \/>\n\tbehalf of the petitioner has submitted that the aforesaid<br \/>\n\tDemand Draft shall be deposited with the Authority during the course<br \/>\n\tof the day.\n<\/p>\n<p>Mr.M.R.Mengdey,<br \/>\n\tlearned Additional Public Prosecutor has requested to pass<br \/>\n\tappropriate order in the facts and circumstances of the case.\n<\/p>\n<p>Having<br \/>\n\theard learned advocates appearing on behalf of the respective<br \/>\n\tparties and considering the subsequent development and settlement<br \/>\n\tbetween the original complainant &#8211; respondent no.1 and<br \/>\n\toriginal accused &#8211; petitioner and considering the fact that<br \/>\n\tthe entire amount due and payable by the petitioner to the<br \/>\n\trespondent no.1 under the cheque in question, has been paid by the<br \/>\n\tpetitioner &#8211; original accused and as the petitioner is also<br \/>\n\tpaying\/depositing a sum of Rs.67,200\/-,  being 15% of the total<br \/>\n\tamount due and payable under the cheque in question, towards costs,<br \/>\n\tto be deposited as observed by the<br \/>\n\tHon&#8217;ble Supreme Court  in the case of Damodar S. Prabhu<br \/>\n\t(supra) and considering the decision of the<br \/>\n\tHon&#8217;ble Supreme Court  in the case of  Damodar S. Prabhu<br \/>\n\t(supra), the petitioner &#8211; original accused and respondent no.1\n<\/p>\n<p>\t&#8211; original complainant, are hereby permitted  to compound the<br \/>\n\toffence committed by the petitioner &#8211; original accused under<br \/>\n\tSection 138 of the N.I.Act and consequently, on deposit of<br \/>\n\tRs.67,200\/- being 15% of the total amount due and payable under the<br \/>\n\tcheque in question, both the impugned judgement and orders, more<br \/>\n\tparticularly judgement and order dated 29\/09\/2010 passed by learned<br \/>\n\tAdditional District Judge and FTC No.2, Nadiad in Criminal Appeal<br \/>\n\tNo.18 of 2010 as well as the judgement and order dated 05\/02\/2010<br \/>\n\tpassed by the learned Judicial Magistrate (First Class), Dakor in<br \/>\n\tCriminal Case No.1154 of 2003 are hereby quashed and set aside.<br \/>\n\tConsequently, if the petitioner herein original accused is in jail,<br \/>\n\the shall be set at liberty forthwith, if not required in any other<br \/>\n\tcase.
