SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 24\/07\/2008 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tPresent<br \/>\nappeal is filed by the appellant ?  original defendant No.2<br \/>\nchallenging the order dated 08.10.2007 passed by the learned<br \/>\nAuxiliary Chamber Judge, Court Court No.10, City Civil Court,<br \/>\nAhmedabad  below Exh.6 and Exh.7 in Civil Suit No.5038 of 2001.\n<\/p>\n<p>2.\t\tIt<br \/>\nappears from the record that earlier in a Suit filed by the<br \/>\nrespondent -original plaintiff against the appellant ?  original<br \/>\ndefendant No.2, an order came to be passed on 07.10.2003 by the<br \/>\nlearned Auxi. Chamber Judge, City Civil Court, Ahmedabad, partly<br \/>\nallowing the Notice of Motion and directed original defendant No.2 ?<br \/>\nCorporation to demolish the illegal construction made by original<br \/>\ndefendant No.2. Said order came to be challenged by the appellant<br \/>\nbeing Appeal from Order No.388 of 2003 before this Court and it was<br \/>\nsubmitted by the learned Advocate appearing on behalf of the<br \/>\nappellant that without prejudice to the rights and contentions of the<br \/>\nparties in the Suit, the appellant will approach the Corporation for<br \/>\nregularization of the illegal construction within 15 days and the<br \/>\nCorporation may decide the matter in accordance with law and<br \/>\naccordingly said Appeal from Order came to be disposed of by order<br \/>\ndated 26.12.2003.  It appears that thereafter, the appellant ?<br \/>\noriginal defendant No.2 submitted application before the Ahmedabad<br \/>\nMunicipal Corporation for regularization of the construction on<br \/>\npayment of impact fees. However, same came to be rejected by the<br \/>\nAhmedabad Municipal Corporation vide order \/ communication<br \/>\ndated 11.05.2006. Therefore, original plaintiff moved application in<br \/>\nthe pending Suit for an appropriate order directing the Corporation<br \/>\nto act as per the earlier order passed below Exh.6 and Exh.7 ?<br \/>\nNotice of Motion and the learned Judge passed the impugned order.<br \/>\nBeing aggrieved and dissatisfied with the said order, the appellant<br \/>\nhas preferred present Appeal from Order.\n<\/p>\n<p>3.\t\tMr.Yatin<br \/>\nSoni, learned Advocate appearing on behalf of the appellant has<br \/>\nvehemently submitted that in fact impact fees has been paid by the<br \/>\nappellant and provisional certificate was issued by the Corporation,<br \/>\ntherefore, learned Judge ought not to have passed the impugned order.<br \/>\nIt is submitted that the Corporation has not accepted and has<br \/>\nrejected the application of the appellant, as revised plans for<br \/>\nregularization is not signed by the original owner. It is submitted<br \/>\nthat the original owner of the property has transferred the property<br \/>\nand subsequent purchaser has not consented. It is submitted that even<br \/>\nsubsequent thereto representation has been made which is still<br \/>\npending before the Corporation. Therefore, it is requested to allow<br \/>\npresent Appeal from Order.\n<\/p>\n<p>4.\t\tAs<br \/>\nstated above, earlier against the order passed below Notice of<br \/>\nMotion, the appellant preferred Appeal from Order before this Court<br \/>\nand same came to be disposed of on the submission made by the learned<br \/>\nAdvocate of the appellant that he would move appropriate application<br \/>\nbefore the Corporation for regularization. It is not in dispute that<br \/>\nthereafter, vide communication \/ order dated 11.05.2006, the<br \/>\nCorporation has rejected the said application for regularization.<br \/>\nSaid order passed by the Corporation has not been challenged.\n<\/p>\n<p>5.\t\tUnder<br \/>\nthe circumstances, when the  Corporation has passed an order<br \/>\nrejecting the application of the appellant for regularization and<br \/>\nsame is not challenged and merely because some representation has<br \/>\nbeen made and impugned order has been passed considering the fact<br \/>\nthat there is illegal construction, it cannot be said that the<br \/>\nlearned trial Court has committed any error.\n<\/p>\n<p>6.\t\tUnder<br \/>\nthe circumstances, present Appeal from Order deserves dismissal and<br \/>\naccordingly it is dismissed.
